ORDINANCE NO. 70-76 <br /> <br />BY: Messrs. Chinnock, Magnotto, McBride, <br /> Salmon, Sinagra, Usher, Brockman <br /> <br /> AN EMERGENCY ORDINANCE to amend Section 505.01 and to enact new <br />paragraph.(c) of Section 505.02 and new Section 505.081 of the General Offenses <br />Code of the Codified Ordinances of the City of Lakewood, to provide for the <br />control of dogs and cats and other animals and for the impoundment of cats. <br /> <br /> WHEREAS, the City has been receiving an ever-increasing number of <br />complaints from its citizens concerning the committing of nuisances committed <br />by animals within the City, particularly cats, and <br /> <br /> WHEREAS, the Ordinances of the City do not adequately provide for <br />the abatement of such nuisances or the punishment for those who permit animals <br />to commit such nuisances, and <br /> <br /> WHEREAS, it is in the best interest of the residents of the community <br />that provisions be made for the impoundment and disposal of cats running at large <br />within the City, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for <br />the immediate preservation of the public health, safety and welfare and for the <br />usual daily operation of a municipal department; now, therefore; <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 505.01 of the General Offenses Code of the <br />Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />505.01 DOGS AND OTHER ANIMALS RUNNING AT LARGE <br /> <br />(a) <br /> <br />No person being the owner or having charge of cattle, sheep, <br />geese, ducks, turkeys, chickens or other fowl or animals <br />shall permit them to run at large upon any public place, or <br />upon any unenclosed lands, or upon the premises of another. <br /> <br />(b) <br /> <br />(c) <br /> <br />No person being the owner or having charge of any dog, whether <br />wearing a registration tag or not, shall permit it to run at <br />large upon any public place or upon the premises of another. <br />No owner, keeper or harborer of any female'dog shall permit <br />such dog to go beyond the premises of such owner or keeper <br />at any time such dog is in heat, unless such dog is properly <br />in leash. The owner or keeper of every dog shall at all <br />times keep such dog either confined upon the premises of the <br />owner or keeper, or under reasonable control of some person. <br /> <br />The running at large of any such animal in or upon any of the <br />places mentioned in this section is prima-facie evidence that <br />it is running at large in violation of this section. <br /> <br />(d) Whoever violates this section is guilty of a minor misdemeanor. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />505.01 DOGS AND OTHER ANIMALS RUNNING AT LARGE <br /> <br />(a) <br /> <br />No person being the owner or having charge of any animals or <br />fowl of any kind in the City shall allow or permit such animals <br />or fowl to run at large upon any public place, or upon any un- <br />enclosed lands, or upon the premises of another. <br /> <br />(b) <br /> <br />No person who is the owner or in charge or control of any dog <br />or cat, whether wearing a registration tag or not, shall permit <br />such dog or cat to run at large within the City. Unauthorized <br />entry by such dog or cat, upon the premises of another or upon <br />any public street or ground shall constitute "running at large" <br />within the meaning of this section. <br /> <br /> <br />
