ORDINANCE NO. 44-77 ~Y: Messrs.' Chtnnock, Magnotto, McBride, Salmon, <br /> Sinagra, Usher, ~Brockman <br /> <br /> AN EMERGENCY ORDINANCE authorizing the ~ayor, on behalf~of the City of <br />Lakewood, to enter into an agreement with tt~e B'oar~t of County~C~mmissioners of ~ <br />Cuyaboga County for the rehabilitation of the Hilliard Road Bridge No. 65 over <br />the Rocky River. <br /> <br /> WHEREAS, tbe County of Cuyahoga and/or the Department of Transportation, <br />State of Ohio, is considering the improvement of:lhe publi~c highway which is <br />hereby described as follows: .. <br /> <br />Rehabilitate Hilliard Road Bridge No. 65 over the Rocky River, and <br /> <br /> WHEREAS, this Ordinance is hereby declared to be an emergency ordinance <br /> immediately necessary for the preservation of the public peace, health and safety, <br /> such emergency ekisting by reason of the present conditJ.on of said bridge and by <br /> reason of the inadequacy of said bridge to handle existing and anticipated. <br /> vehicular traffic over the Rocky River; in consequence whereof great public <br /> inconvenience is being suffered and will be suffered and public vehicular traffic <br /> endangered and delayed; and for the further reason that it is necessary to <br /> expedite the development of the plans for the rehabilitation of said bridge; now, <br />~therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF L~dIEWOOD, STATE OF OHIO: <br /> <br /> Section 1. <br />that the consent of said Municipality be and such consent is hereby given to the <br />County of Cuyahoga and/or the Department of Transportation, State of Ohio, to <br />rehabilitate the above described bridge, in accordance with plans, ~ecificat~ons. <br />and estimates as approved by the County and/or the Department of Transportation, <br />State or. Ohio; provided however, it is a condition of this consenC that the <br />rehabilitation of the Hilliard Road Bridge #65 shall not impede traffic over s~id <br />structure when there are no means to traverse the Detroit Rocky River Bridge. <br /> <br />(Consent). That it is declared to be in the public ~i-nterest <br /> <br /> Section 2. (Cooperation). That said Municipality hereby propose.,; to <br />cooperate with the County and/or the Department of Transportation, State of Ohio, <br />in the cost of the above described., improvement as follows: <br /> <br />(a) <br /> <br />By the approval of an application by the Board of County Commissioners <br />for municipal cooperation with the County in the cost of the improve- <br />ment project to the extent of f,nds received by an allocati~n from <br />the County Motor Vehicle $5.00 License Tax Fund. <br /> <br />(b)~ There shall be no roadwmy participation by Said Munic~paiity~for <br /> the aforesaid improvement other than the $5.00 License Tax Funds. <br /> <br /> - Section 3. (Authority to Sign). That the Mayor of said M,nicipal~.y Js <br />hereby authOrized to.~nter into maintenance and parking agreements and special.~.contrac- <br />tual obligations. <br /> <br /> Section 4. (Maintenance and Parking). That upon 'completion of said <br />improvement said Municipality will t[~ereafter keep said bridge open to traffic at <br />all times, and <br /> <br />(a) <br /> <br />Maintain the improvement in accordance with the provisions of the <br />statutes relating thereto and make ample financial provisions for <br />such maintenance; '~' <br /> <br />(b) <br /> <br />Maintain the right-of-way and keep it free of obstructions in a <br />manner satisfactory to the County and/or the Department of'Trans- <br />portation, State of Ohio, and bold said right--of-way inviolate for <br />public highway purposes and permit no signs, posters, billboards, <br />roadside stands or other private installations within the~right-of- <br />way limits; and <br /> <br />(c) <br /> <br />Prohibit parking w[.t'hln, the limits of tile roadway improved ,nder <br />this ordinance, within the corporate limits of the Municipality; <br />and <br /> <br />(d) <br /> <br />Enact no rule or regulatfon restricting the use of 'the improved <br />road and/or structure by any class of vehicle or vehicle load <br />permitted by the Ohlo Revised Code to use a public highway. Any <br />existing rule or regulation so restricting road usage is hereby <br />rescinded. <br /> <br /> <br />
