ORDINANCE NO. 9-78 <br /> <br />BY: Messrs. Magnotto, McBride, <br /> Salmon, Usher, Brockman, <br /> Brown, Chinnock <br /> <br /> AN EMERGENCY ORDINANCE approving a Collective Bargaining Agreement <br />with the Western Cuyahoga Fraternal Order of Police Lodge Number 25 - Lakewood <br />Division, establishing conditions of employment, working conditions and various <br />benefits for certain employees of the Division of Police of the City of Lakewood, <br />authorizing the Mayor and the Director of Finance to sign said Agreement on <br />behalf of the City and ratifying their signatures affixed, thereto. <br /> <br /> WHEREAS, a prior Collective Bargaining Agreement entered into <br />between the City of Lakewood and the Western Cuyahoga Fraternal Order of Police <br />Lodge Number 25 - LakeWood Division, terminated on December 31, 1977, and <br /> <br /> WHEREAS, discUssions and negotiations have been conducted on behalf <br />of the City with representatives of the said Western Cuyahoga Fraternal Order <br />of Police Lodge Number 25 - Lakewood Division, with respect to conditions of <br />employment, working conditions and various benefits for certain employees of <br />the Division of Police of the City of Lakewood, and <br /> <br /> WHEREAS, an agreement has been reached in the course of said discussions <br />and negotiations with respect to the conditions of employement, working <br />conditions and various benefits for the certain employees aforementioned, and <br /> <br /> WHEREAS, this Council determines that.it is in the best interest of <br />.the City to approve said Collective Bargaining Agreement and to authorize the <br />Mayor and Director of Finance to sign same on behalf of the City and to ratify <br />their signatures affixed thereto, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for <br />the immediate preservation of the public health, safety and welfare and for the <br />usual daily operation of a municipal department, and fOr the further reason that <br />it is necessary for the approval of said Agreement at the earliest possible time, <br />now, therefore, · <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Collective Bargaining Agreement with the Western <br />Cuyahoga Fraternal Order of Police Lodge Number 25 - Lakewood Division dated <br />January 16, 1978 and effective for the period January 1, 1978 to December 31, <br />1979, an original copy of which is on file in the office of the Mayor of the <br />City of Lakewood and is made a part hereof as though written fully herein, is <br />hereby adopted, ratified and approved and the Mayor and the Director of Finance <br />are hereby authorized and directed for and on behalf of the City to affix their <br />signatures thereto and their Signatures affiXed thereto are hereby ratified. <br /> <br /> Section 2. That all other ordinances or resolutions, or parts of <br />ordinances or resolutions which are inconsistent with this Ordinance and the <br />Collective Bargaining Agreement made a part hereof are hereby repealed as of <br />January 1, 1978 to the extent that they pertain to employees in the bargaining <br />unit covered by the Collective Bargaining Agreement and are inconsistent with <br />this Ordinance including the Collective Bargaining Agreement attached hereto <br />and made a part hereof. <br /> <br /> Section 3. That this Ordinance is hereby declared to be an emergency <br /> measure for the reasons stated in the preamble hereof and provided it receives <br /> the affirmative vote of two-thirds of all members elected to Council, it shall <br /> take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise it shall take effect and be in force from and after the ear~_ <br />period allowed by law. <br /> <br />Adopted: <br /> <br /> .?
