ORDINANCE NO. I01-78 <br /> <br />BY: Salmon, Wendl~ng, Brockman, <br /> Brown, Chinnock, McBride <br /> <br /> AN EMERGENCY ORDINANCE to amend Section 1509.03 of the Regional <br />Dwelling House Code of the Codified Ordinances of the City of Lakewood <br />relating to the penalties for violations. <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure <br />providing for the usual daily operation of a municipal department; <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COLIN~IL OF THE CITY OF <br />I2tKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 1509.03 of the Regional Dwelling House <br />Code of the Codified Ordinances of the City ofLakewoodnowreading as <br />follows: <br /> <br />1509.03 GENERAL PENALTY <br /> <br /> Any person, firm or corporation violating any of the <br />provisions of this Dwelling House Code shall be deemed guilty <br />of a misdemeanor and upon the conviction of any such violation, <br />such person shall be punishable by a fine of not more than <br />$300.00 orby imprisonment of not more than three months or <br />by both such fine and ir~prisonment. Such person, firm or <br />corporation shall be deemed guilty of a separate offense for <br />each and every day or portions thereof during which any <br />violation of any of the provisions of this E~lling House <br />Code is committed, continued or permitted. <br /> <br />be and the same is hereby amended to read as follows: <br /> <br />1509.03 GENERAL PENALTY <br /> <br /> Any person, firm or corporation violating any provision <br />of this Dwelling House Code shall be deemed guilty of a <br />misdemeanor of the third degree. If the offender has been <br />previously convicted of a violation of this section, a <br />violation is a misdemeanor of the second degree. Such <br />person, firm or corporation shall be deemed guilty of a <br />separate offense for each and every day or portions thereof <br />during which any violation of any of the provisions of this <br />Dwelling House Code is committed, continued or permitted. <br /> <br /> Section 2. Thi~ Ordinance is hereby declared tobe an emergency <br />measure for the reasons stated in the preamble hereof and provided it <br />receives the affirmative vote of two-thirds of all members elected to <br />council, and shall take effect and be in force immediately upon its adoption <br />and approval by the Mayor; otherwise it shall take effect and be in force <br />fromand after the earliestperiod allowed by/law and existing Section <br />1509.03 shall be and the same is hereby repe~ed. <br /> <br />Approved: ~ ~.~ /~/~ <br /> <br /> <br />
