ORDINANCE NO. 102-78 BY: <br /> <br /> AN EMER~ ORDINANCE to amend Section 1603.89 of the Regional <br />Building Code of the Codified Ordinances of the City of Lakewood relating <br />to the penalty for failing to secure a permit. <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure pro- <br />viding for the usual daily operation of a municipal department; <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITYOF <br />IAKEBI)DD, STATE OF OHIO: <br /> <br /> Section 1. That Section 1603.89 of the Reqional Building Code <br />of the Codified Ordinances of the City of Lakewood nc~ reading as follows: <br /> <br />1603.89 FOR FAYTLRRE TO SECURE PERMIT <br /> <br /> Whoever performs any work or installs any appliance, <br />device, or equipment without first securing the permit required <br />therefor under the provisions of this Code; or refuses, neglects, <br />or fails to secure anypermit required under the provisions of <br />this Code for the storage, use, or handling of a hazardous sub- <br />stance, shall be guilty of a misdemeanor and upon conviction <br />thereof shall be fined not less than $20.00 nor more than $300.00 <br />for a first offense, and for a second or subsequent offense shall <br />be fined not less than $50.00 norm ore than $500.00. <br /> <br />be and the same is hereby amended to read as follows: <br /> <br />1603.89 FOR FAII33RE TO S~JRE PERMIT <br /> <br /> Whoever performs any work or installs any appliance, <br />device, or equitm~_nt without first securing the permit required <br />therefor under the provisions of this Code; or refuses, neglects, <br />or fails to secure any permit required under the provisions of <br />this Code for the storage, use, or handling of a hazardous sub- <br />stance, shall be guilty of a misdemeanor of the third degree. <br />If the offender has been previously convicted of a violation <br />of this section, a violation is a misdemeanor of the second <br />degree. <br /> <br /> Section 2. This Ordinance is hereby declared to be an emergency <br />measure for the reasons s.tated in the preamble hereof and provided it <br />receives the affirmative vote of two-thirds of all members elected to <br />council, and shall take effect and be in force ~ately upon its adoption <br />and approval by the Mayor; otherwise it shall take effect and be in force <br />from and after the earliest period allowed by law and existing Section <br />1603.89 shall be and the same is hereby repealS. <br /> <br /> <br />
