ORDINANCE NO.: 10-78 BY: Messrs. Salmon, Usher, Brockman,
<br /> Magnotto, McBride, Brown, Chinnock
<br />
<br /> AN EMERGENCY ORDINANCE authorizJn9 and directing the Director of
<br />Public Works to employ by contract the G & R Sewer Construction Company,
<br />1422 Mendelssohn Drive, Westlake, Ohio, 44145 for the purpose of constructing
<br />a new 8" feeder water main from Lake Avenue in Clifton Park to the water main
<br />distribution net in the Clifton Lawoon area in an amount not to exceed $50,000.
<br />
<br /> WHEREAS, on February 4, 1978 a severe water leak was discovered on
<br />the existing 8" feeder main that supplies water service to the Clifton Lagoon
<br />water main net, and,
<br />
<br /> WHEREAS, the severe leak in the existing 8" feeder main is located
<br />'under a single family dwelling located at 17878 Lake Road and it is not
<br /> possible to repair this break because it is located under the dwelling, and,
<br />
<br /> WHEREAS, the 8" existing feeder main is approximately 90 years of
<br />age, in poor condition and subject to further breaks at any time, and,
<br />
<br /> WHEREAS, the Division of Water of the City of Lakewood has provided
<br />a limited temporary water feeder supply line to the water main distribution
<br />net in.the Clifton Lagoon area, and,
<br />
<br /> ~HEREAS, the City does not have necessary equipment and manpower
<br />to complete construction of a new 8" feeder water main, and,
<br />
<br /> WHEREAS, a real and present emergency exists in th~ it is necessary
<br />to proceed without delay in the installation of a new 8" water feeder main to
<br />insure the restoration of normal water service to the Clifton Lagoon area at
<br />the earliest possible time and for the reason that further delay would be
<br />dangerous to the health, safety and welfare of the citizens of Lakewood, and,
<br />
<br /> WHEREAS', a delay, in order to comply with the competitive bidding
<br />requirements of the Charter of the City of Lakewood, will be dangerous to
<br />the health, safety and welfare of the citizens of Lakewood, and,
<br />
<br /> WHEREAS, pursuant to the Ohio Revised Code 735.051, the legislative
<br />authority of a municipal corporation may, bY a two-thirds vote, contract for
<br />the purchase of construction work without formal bidding and advertising in
<br />the case of a real emergency arising in connection with the operation and
<br />maintenance of ti%e Department of Public Works, and,
<br />
<br /> WHEREAS, this Ordinance constitutes an emergency in that it provides
<br />for the immediate preservation of the public health, safety, welfare and property
<br />and provides for the usual daily operation of a municipal department, now,
<br />therefore,
<br />
<br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAK~WOOD, STATE OF OHIO:
<br />
<br /> Section 1. That the Director of Public Works be and he is hereby
<br />authorized to emply by contract the G & R Sewer Construction Company, 1422
<br />Mendelssohn Drive, Westlake, Ohio 44145 on a time and material basis for the
<br />purpose of installing approximately 800' of new 8" feeder water main to the
<br />Clifton Lagoon area for a total sum not to exceed $50,000.
<br />
<br /> Section 2. That the Director of Finance is hereby authorized and
<br />directed to pay G & R Sewer Construction Company for all material, labor and
<br />equipment necessary to install said water main in a total amount not to
<br />'exceed $50,000 . Said sum to be charged to the water COD fund.
<br />

<br /> Section 3. That this ordinance is hereby declared an emergency
<br />measure for the reasons stated in the preamble hereof and provided it receives
<br />the affirmative vote of two-thirds of all members elected to council, it
<br />shall take effect and be inforced immediately upon its adoption and approval
