ORDINANCE NO. 39-78 <br /> <br />BY: Messrs. McBride, Salmon, <br /> Usher, Brockman. Brown, <br /> Chinnock, Magnotto <br /> <br /> AN EMERGENCY ORDINANCE to amend Paragraph (e) of Section 351.23 <br />of the Traffic Code of the Codified Ordinances of the City of.Lakewood to <br />prohibit persons who are not handicapped or who are not operating motor <br />vehicles to transport a handicapped person, from stopping or parking in <br />special..parking locations provided for handicapped persons. <br /> <br /> WHEREAS, sometime back the Ohio General Assembly passed a law <br />which required the state and all political subdivisions to provide and <br />designate special locations for disabled persons and our ordinances were <br />amended at that time to confonn to the state law, and <br /> <br /> WHEREAS, Amended House Bill No. 652 became effective on March 13, <br />1978, the law prohibiting non-handicapped persons from parking at special <br />locations reserved for the handicapped, and <br /> <br /> %%5{EREAS, the Codified Ordinances of the City of Lakewood should <br />be amended to conform to the state law so that we would be ~)le to prosecute <br />the violaters under our own ordinances, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the public safety mhd welfare and the tusual daily operation of a municipal <br />department, now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF L4K~OOD, STATE OF <br /> <br />OHIO: <br /> <br /> Section 1. That Paragraph (e) of Section 351.23 of the Traffic <br />Code of the Codified Ordinances of the City of Lakewood.reads as follows: <br /> <br />351.23 ~YHODS OF PARKING <br /> <br />(e) <br /> <br />Special parking locations and privileges for the handicapped <br />shall be provided and designat~ by the City and all agencies <br />and instrumentalities thereof at all offices and facilities, <br />where parking is provided, whether o~ed, rented or le~sed, <br />and at all publicly owned parking garages. Such locations <br />shall be reasonably close to exits, entrances, elevators <br />andramps. <br /> <br />When a motor vehicle bearing the special handicapped license <br />plate providedin Ohio R.C. 4503.105 is being operated by or <br />for the transport of a handicapped person, the motor vehicle <br />shall be permitted to park for a period of two hours in <br />excess of the legal parking period permitted by ordinances <br />or regulations, except where such ordinances or regulations <br />specifically provide otherwise or where the vehicle is <br />parking in such a manner as to be clearly a traffic hazard. <br /> <br />As used in this section, "handicapped" means having lost <br />the use of one or both legs, one or both arms, or any <br />combination thereof, or being blind or deaf or so severely <br />disabled as to be unable to move about without the aid of <br />crutches or a wheelchair. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />351.23 ME'Il{ODS OF PARKING <br /> <br />(e) <br /> <br />Special parking locations and privileges for the handicapped <br />shall be provided and designated by the City and all agencies <br />and instrumentalities thereof at all offices and facilities, <br />where parking is provided, whether owned, rented or leased, <br />and at all publicly owne~ parking garages.
