ORDINANCE NO. 39-78 BY: Messrs. McBride, Salmon, Usher, Brockman. Brown, Chinnock, Magnotto AN EMERGENCY ORDINANCE to amend Paragraph (e) of Section 351.23 of the Traffic Code of the Codified Ordinances of the City of.Lakewood to prohibit persons who are not handicapped or who are not operating motor vehicles to transport a handicapped person, from stopping or parking in special..parking locations provided for handicapped persons. WHEREAS, sometime back the Ohio General Assembly passed a law which required the state and all political subdivisions to provide and designate special locations for disabled persons and our ordinances were amended at that time to confonn to the state law, and WHEREAS, Amended House Bill No. 652 became effective on March 13, 1978, the law prohibiting non-handicapped persons from parking at special locations reserved for the handicapped, and %%5{EREAS, the Codified Ordinances of the City of Lakewood should be amended to conform to the state law so that we would be ~)le to prosecute the violaters under our own ordinances, and WHEREAS, this ordinance constitutes an emergency measure providing for the public safety mhd welfare and the tusual daily operation of a municipal department, now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF L4K~OOD, STATE OF OHIO: Section 1. That Paragraph (e) of Section 351.23 of the Traffic Code of the Codified Ordinances of the City of Lakewood.reads as follows: 351.23 ~YHODS OF PARKING (e) Special parking locations and privileges for the handicapped shall be provided and designat~ by the City and all agencies and instrumentalities thereof at all offices and facilities, where parking is provided, whether o~ed, rented or le~sed, and at all publicly owned parking garages. Such locations shall be reasonably close to exits, entrances, elevators andramps. When a motor vehicle bearing the special handicapped license plate providedin Ohio R.C. 4503.105 is being operated by or for the transport of a handicapped person, the motor vehicle shall be permitted to park for a period of two hours in excess of the legal parking period permitted by ordinances or regulations, except where such ordinances or regulations specifically provide otherwise or where the vehicle is parking in such a manner as to be clearly a traffic hazard. As used in this section, "handicapped" means having lost the use of one or both legs, one or both arms, or any combination thereof, or being blind or deaf or so severely disabled as to be unable to move about without the aid of crutches or a wheelchair. shall be and the same is hereby amended to read as follows: 351.23 ME'Il{ODS OF PARKING (e) Special parking locations and privileges for the handicapped shall be provided and designated by the City and all agencies and instrumentalities thereof at all offices and facilities, where parking is provided, whether owned, rented or leased, and at all publicly owne~ parking garages.
