ORDINANCE NO. 84-78 BY: Salmon, Wendling, Brockman, Brown, Chinnock, Magnotto, McBride AN EMERGENCY ORDINANCE authorizing the Mayor, as ex-officio Director of Public Works, to advertise for bids for the leasing of the entire sixth floor of the Municipal NOrth Parking Garage on Belle Avenue in the City, which property is now owned by the City of Lakewood and determining that it is in the best interests of the City that the entire sixth floor of said garage be leased on a long-term basis. WHEREAS, the City is the owner of a municipal off-street parking garage situated on Belle Avenue and known as "North Parking Garage", and WHEREAS., it has come to the attention of this Council that there has been interest expressed in leasing the entire sixth floor of the North Parking Garage on'a long-term basis, and WHEREAS, this Council is of the opinion that it is in the best interest of the City that'the entire sixth floor of the North Parking Garage be so leased, and ~EREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CI~TY OF LAKEWOOD, STATE OF OHIO: Section 1. That this Council determines that the entire sixth floor of the municipal North Parking Garage located on Belle Avenue in the City should be leased on a long-term basis and .that such lease or leases are.in the best interest of the City. Section 2. That this Council determines that the leasing of the entire sixth floor of the municipal North Parking Garage, as noted in Section 1, hereof, will further the interests of the City and its residents. Section 3. That the Mayor, as ex-officio Director of Public Works, is hereby authori~zed and directed to advertise for bids for the leasing of the entire sixth floor of the North..Parking Garage for a term of two years. Section 4. That said advertisement shall state that any leasing of any portion of said North~Parking Garage shall be subject to the approval of Council; that one bid will be received for all 185 spaces on the sixth floor, without cover, of the North Parking Garage for a two-year period with the minimum bid of five dollars ($5.00)per space per. month, and that the Cfty reserves the right to reject any and all bids and any parts'thereof, and either party may have the right to terminate upon 60 days written notice after one year. Section 5. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof anc~ provided it receives the affirmative vote of two-thirds of all members elected to council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise it shall take effect and be in force from and after the earliest period allowed by law. /// ~' -.
