ORDINANCE NO. 6-79 BY': Magnot:to, McBride, Salmon, Wendling, Brockman, Brown, Chinnock AN EME. RGENCY ORDINANCE amending Paragraph (e) of Section 1305.07 of the Building Code of the Codified Ordinances of the City of Lakewoo'd ~elating to the'definition of a cellar. WHEREAS, this ordinance constitutes an emergency measure providing for the immediate.preservation of the public safety and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF'THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Paragraph (e) of Section 1305.O7 of the Building Code of the Codified Ordinances of the City of Lakewood now reading as follows: 1305.O7 DEFINITIONS. For the purposes of this Code, the following words and phrases shall have the meaning set forth in the following sections: (e) "Cellar" means a space having half or more than half of its clear height below adjoining ground. be and the same is hereby amended to read as follows: 1305.07 DEFI.NITIONS. For the purposes of this COde, the following words and phrases shall have'the meaning set forth in the following sections: (e) "Cellar" means a space having more than one-half (1/2) of its clear height below the adjoining ground. Excavations made for the purpose of Window wells and/or retaining walls shall not be considered in the determination of the adjoining ground. Approved: Section 2. That this ordinance is.hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thii-ds of all members elected to Council, it sh'all take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise it shall take effect and be in force from and after the earliest period al lowed by law and existing Par'agraph (e) of' Section ]305.07 shall be and the same is hereby repealed at such time. · ~ Presi'dent//~
