ORDINANCE NO. 32-79 <br /> <br />BY: Brown, Chinnock, Magnotto, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE approving a Collective Bargaining Agreement with <br />Ohio Council 8 and Local 1043 of the American Federation of State, County and Muni- <br />ci?~] Employees AFL-CIO establiShing condi.tions of employment, working conditions and <br />various benefits for certain employees of the Depa'rtment of Public Works of the City <br />of lakewood and authorizing the Mayor to sign said Agreement on behalf of the City. <br /> <br /> WHEREAS, a .prior Collective Bargaining Agreement entered into between the <br />C!t'! of Lakewood and Ohio Council 8 and Local 1043 of the American Fed.erati'on of <br />State, County and Municipal Employees AFL-CIO terminated on February 28, 1979, and <br /> <br /> WHEREAS, discussions and'negotiations have been continued subsequent on <br />beh~?f of the City with representatives of Local Union 1043 and Ohio Council 8 with <br />respect to conditions of employment', working conditions, and various benefits for <br />certain employees of th~ Department of Public Works of the City of Lakewood, and' <br /> <br /> WHEREAS, agreement has been reached in the course of said discussions and <br />neg~tiations with respect to the conditions of employment, working-conditions.and <br />w~r~ous benefits for certain employees aforementioned, and <br /> <br /> WHEREAS, this Council determines that it is in the best interest of the <br />Cit'W to, approve said Collective Bargaining Agreement and authorize the Mayor to <br />si~n same on behalf of the City, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergenCy measure providing for the <br />~r ....... Jiate preservation of the public health, safety and welfare and for the us-ual <br />daill operation of a municipal department, and for the further' reason that it is <br />ne~x~sary to approve said Agreement at the earliest possible time, now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF' OHIO: <br /> <br /> 'Sectic~ ]. That the Collective Bargaining Agreement with Ohio Council 8 <br />~:d Lc'cai 1043 of the American Federation of State, County and Municipal Employees <br />&F!_.-CiO and effective for the period March 1, ]979, to February 28, 198], an <br />er:giF~a] copy of: which is on file in the Office of the Mayor of the City of Lakewood <br />;~r',d is made a part hereof as though written fully herein, is. hereby adopted, ratified <br />~r~ct ~!,proved and the Mayor is hereby authorized and directed for and on behalf of the <br />City of Lakewood to affix his signature thereto. .. <br /> <br /> Section 2. That all other ordinances or resolutions or parts of ordinances <br /> ~::~o~'~tions which are inconsistent with the provisions of this ordinance and/or <br /> =~ctive Bargaining Agreement made a part hereof, are hereby repealed as of <br /> l, ]979, to the extent that they pertain to the employees in the bargaining <br /> .~'~vered by the Collective Bargaining Agreement and are i,nconsistent with this <br />,..~di~t,'~nce, including the Collective Bargaining Agreement referred to herein and <br /> part hereof. <br /> <br /> Section 3~ 'lhai~ !:!"~!~ ;'~rdinance is hereby declared to be a.n emergency <br />m~:~s~4~'e for the reasons st~Eed in t~e preamble hereof and provided it receives <br />the ~Ffirmative vote of two-thirds of a11 members elected to Council, it shall take <br />eFfec~ and be in force immediately upon its adoption and approval by the Mayor other- <br />wi~e it shall take effect at the earliest period provided by law. <br /> <br /> <br />
