Approved: <br /> <br /> ORDINANCE NO. 49-79 <br /> BY: Br0ckman, Brown, Chinn0ck, <br /> McBride, McNa]]y, Salmon, <br /> Wend!ing <br /> AN EMERGENCY ORDINANCE authorizing the Mayor, as ex-officio Director <br /> <br /> of Public Works, to advertise for bids and enter into a contract With the lowest <br /> and best bidder for the grading of land, construction of a tennis court, con- <br /> struction of a fence, and other work necessary to provide a public park at the <br /> southeast corner of the intersection of Merle Avenue and Bunts Road. <br /> <br /> WHEREAS, Council has previously approved, the submittal of the proposed <br /> park at the corner of Bunts Road and Merle Avenue as a project for partial funding <br /> <br /> by the Ohio Department of Natural ·Resources, and <br /> <br /> WHEREAS, plans for this park have been modified to reflect the input of <br /> Lakewood residents at the April 25, 1979 public hearing, and <br /> <br /> WHEREAS, plans and construction drawings for the proposed park are <br /> <br /> nearing completion, and <br /> <br /> WHEREAS., an early start on this project is desired so that it may be <br /> <br /> completed during the 1979 conStruction season, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br /> <br /> the usual daily operation of a municipal department and for the immediate preserva- <br /> <br /> tion of the public safety and welfare; now, therefore <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. That the Mayor, as ex-officio Director of Public Works, be <br />and he is hereby authorized and directed to advertise for bids and enter into a <br />contract with the lowest and best bidder after advertisement according to law <br />for the grading of land, construction of a tennis court, construction of a fenCe, <br />and other work necessary to provide a public park at the southeast corner of the <br />intersection of Merle Avenue and Bunts Road in the City of Lakewood. <br /> <br /> · Section 2. That the cost of such construction is estimated at $35,000.00, <br /> <br />which funds are to be evenly divided between funds approved by the Ohio Department <br /> <br />of Natural Resources and Federal Revenue Sharing Funds. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency <br /> <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the Mayor; <br />otherwise it shall take effect and be in fOrce after the earliest period allowed by <br />law. , ~ <br /> <br /> · ~ Clerk~j/ <br /> <br /> <br />
