ORDINANCE NO. 72-79 BY: <br /> <br />Brockman, Brown,'Chinnock, <br />McBride,McNally, Salmon, <br />Wendling <br /> <br /> AN EMERGENCY ORDINANCE to supplement Chapter 521 of the General <br />Offenses Code of the Codified Ordinances of the City of Lakewood by enacting <br />new Section 521.14 to prohibit the sale of tobacco to minors. <br /> <br /> WHEREAS, the Surgeon General of the United States has determined <br />that cigarette smoking is dangerous to your health, and <br /> <br /> WHEREAS, in the interest of the public health, the sale of <br />cigaretts and tobacco products should be prohibited to persons under the age <br />of eighteen (18) years, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public heaqth, safety and welfare and for <br />the usual daily operation of a municipal department; now, therefore, <br /> <br />OHIO,: <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF. LAKEWOOD, STATE OF <br /> <br /> .Section 1. That Chapter 521 of the 'General Offenses Code of the <br />Codified Ordinances of the City of Lakewood be supplemented by enacting new <br />Section 521.14 to read as follows: <br /> <br />521.14 SALE OF TOBACCO TO MINORS PRO)(IBITED <br /> <br />(a) <br /> <br />Ilo person shall sell, give or furnish to a person under <br />eighteen (18) years of age a cigarette, cigarette <br />wrapper or substitute for either, or a cigar or tobacco. <br /> <br />(b) <br /> <br />Every place in the City where tobacco products are <br />sold shall display at all times in a prominent place <br />on the premises thereof, a printed card which shall be <br />furnished by. the City and which shall read substantially <br />as follows: <br /> "Under the ordinances of the City of Lakewood, <br /> it is unlawful to sell, give or furnish to a <br /> person under eighteen (18) years of age a <br /> cigarette or other tobacco, products." <br /> <br />(c) Whoever violates any of the provisions of this Section <br /> is guilty of a minor misdemeanor. <br /> <br /> Section 2. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affi.rmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force i)~ediately upon its adoption and approval by the <br />Mayor, otherwise it shall take effect and be in force from and after the earliest <br />period allowed by law. . ~__ <br /> <br /> // Cler <br />Appr°ved: ~r~ ~/~7~ ~ <br /> <br /> <br />
