ORDINANCE NO. 76-79 <br /> <br />BY: McNally, Salmon, Wendling, <br /> Brockman, Brown, Chinnock, McBrid <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor as ex-officio Director <br />of Public Works to execute a Step II Grant Agreement with the Environmental <br />Protection Agency and to enter into a contract with Watermation, Incorporated <br />for the Step II work consisting of the detailed design and preparation of <br />specifications and construction drawings for the improvements in the Lakewood <br />Wastewater Treatment Plant and its.ancillary systems in accordance with the <br />Lakewood Facility Plan. <br /> <br /> WHEREAS, it is necessary to comply with Public Law 92-500 the <br /> Federal Water Pollution Control Act, and ' ' <br /> / <br /> WHEREAS, the City of Lakewood has submitted to the Environmental <br /> Protection Agency a Facility Plan and a Step II Grant Application, and <br /> <br /> WHEREAS, the Environmental Protection Agency has approved the Lakewood <br /> Facility Plan and has advised the City that the federal 75% share of funds, in <br /> the amount of $1, 366,350, has been made available for the Step II work and <br /> <br /> WHEREAS, the Environmental Protection Agency has advised the City that <br /> the Step II Grant Agreement must be executed by the City and returned to the <br /> Environmental Protection Agency by October 26, 1979, and <br /> <br /> WHEREAS, the firm of Watermation, Incorporated prepared the Lakewood <br /> Facility Plan and Step II Grant Application, which includes a proposed contract <br /> between the City of Lakewood and Watermation, Incorporated, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />.the immediate preservation of the public health, safety and welfare and for the <br /> further reason that it is in the interest of the public service, Welfare and <br /> safety to proceed with the Step II work relating to our Wastewater Treatment <br /> Plant and ancillary systems at the earliest possible time; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CI'TY OF LAKEWOOD, STATE OF <br />OHIO: <br /> <br /> Section 1. That the Mayor as ex-officio Director of Public Works be <br />and he is hereby authorized and directed to execute a.Step II Grant Agreement <br />with the Environmental Protection Agency and employ by contract the firm of <br />Watermation, Incorporated, 2304 University Avenue, St. Paul, Minnesota as <br />consulting engineers for the purpose of performing detailed design work and the <br />preparation of specifications and construction drawings necessary for the <br />implementaion of the improvements in the City's Wastewater Treatment Plant and <br />ancillary facilities in accordance with the approved Facility Plan. <br /> <br /> Section 2. That the City of Lakewood's 25% share of the total cost <br />for this work is estimated at $455,450.00, and the funds for this work are to be <br />provided by the Wastewater Sewer Facility Fund. <br /> <br /> Section 3. It is found and determined that all formal actions of this- <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action, were in meetings <br />open to the public, in compliance with all legal requirements including Section <br />121.22 of the Ohio Revised Code. <br /> <br /> Section 4. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise it shall take effect <br />allowed by law. <br /> <br />Approved:~/~ ~'~0, /~,~y <br /> <br />and be i~.'orce after t~e earliest period <br /> <br /> ' ///'---~-~ayor ~ <br /> <br /> <br />
