ORDINANCE NO. 88-79 <br /> <br />BY: McNally, Salmon, Wendlinq, <br /> Brockman, Brown, ChinnocR, <br /> McBride <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor on behalf <br />of the City of Lakewood to purchase the certain real estate located at 1364 Warren <br />Road, Lakewood, Ohio, hereinafter more particularly described. <br /> <br /> WHEREAS, Phase I of the Town Center Plan has been authorized by this <br />Council and additional parking requirements in the Warren Road area are anticipated <br />by reason thereof, and <br /> <br /> WHEREAS, the property located at 1364 Warren Road, Lakewood, Ohio, which <br />abuts existing Parking Lot #1, is available for purchase and this Council believes <br />that it is in the best interests of the City to purchase said lot for parking <br />purposes, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />the immediate preservation of the public safety and welfare and for the usual daily <br />operation of a municipal department and for the further reason that the owners have <br />agreed to sell said property for the consideration herein stipulated and this Council <br />determines it to be in the best interest of the City that the property be purchased <br />as soon as possible so that additionally needed parking requirements can be initiated <br />at the earliest possible time; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby authorized and directed <br />to purchase from John Hess and Barbara J. Jones the following described property: <br /> <br />Situated in the City of Lakewood, County of Cuyahoga, and State <br />of Ohio and known as being Sublot NO. 147 in Lakewood Park <br />Subdivision 'of a part of Original Rockport Township Section 22 <br />as shown by the 'recorded plat in Volume 24 of Maps, Page 26 of <br />'Cuyahoga County Records and being 40 feet front on the Westerly <br />side of Warren Road and extending back 120.31 feet on the <br />Northerly line, 119.92 feet on the Southerly line, and having a <br />rear line of 40 feet, as appears by said plat, be the same more <br />or less, but subject to all legal highways. <br /> <br />and to pay therefor the sum of Forty-Two Thousand Five Hundred Dollars ($42,500.00). <br /> <br /> Section 2. That the title to said property shall be subject to the <br />a-~roval of the Director of Law; that taxes and assessments shall be prorated as <br />of the date of the filing of the Deed for record using the last available tax rate <br />and valuation for computing tax prorations; that the Director of Finance be and <br />he is hereby authorized to pay the amount set forth in Sectioh I hereof from the <br />Parking Facilities Fund upon delivery by the Grantors of a good and sufficient <br />Warranty Deed to the City of Lakewood, together with guarantee of title disclosing <br />the said real estate to be free and clear of all encumbrances excepting taxes and <br />assessments not yet due ana payable, zoning ordinances and restrictions of record, <br />if any; and that the Director of Finance be and he is hereby authorized to pay <br />the City's share of expenses incidental to the completion of the purchase, including <br />the cost of recording the Deed, one-half of the escrow fee and any prorata share <br />chargeable to the City as purchaser. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated i-n the preamble hereof and provided it receives the <br />affirmative vote of two-'thirds of all members elected to Council, it shall take <br />effect and be in force immediately upon its adoption and approval by the Mayor, <br />otherwise it shall take effect and be in force fro~and after the earliesj~ period <br />allowed by law. <br /> <br /> ' x ~ ~M~yor~~~ ~~~~ <br /> <br /> <br />
