ORDINANCE NO. 4-80 <br /> <br />BY: Wendling, Brown, Chinnock, <br /> Gallagher, Graham, Salmon, <br /> McBride <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Director of <br />Public Works to take competitive bids without advertising to enter <br />into a contract for the construction of an eight-inch diameter <br />water main on Lincoln Avenue from Ba~es Avenue to Athens Avenue <br />approximately three hundred feet (300') and declaring an emergency. <br /> <br /> WHEREAS, pursuant to Ohio Revised Code Section 735.051 <br />the legislative authority may by two--thirds vote authorize the <br />Director of Public Works to enter into a contract without formal <br />bidding and advertising in the case of a real and present emergency <br />and , <br /> <br /> WHEREAS, in order to properly maintain Lincoln Avenue <br />between Bayes Avenue and Athens Avenue and to prevent continued <br />deterioration of said street, it is immediately necessary to <br />enter into a contract for the construction of a new water main <br />under said street, and <br /> <br /> WHEREAS , an emergency exists in the usual daily <br />operation of the Department of Public Works and it is immediately <br />necessary to enter into a contract for the aforesaid improvement <br />for the immediate preservation of the public health, safety and <br />welfare; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAK~?WOO~,.~. · <br />STATE OF OHIO: <br /> <br /> Section 1. that the Director of Public Works is <br />hereby authorized and directed to take competitive bids without <br />advertising and to enter into a contract for the construction of <br />an eight-inch diameter water main on Lincoln Avenue from Bayes <br />Avenue to Athens Avenue approximately three hundred feet (300'). <br /> <br /> Section 2. The cost of said contract shall not exceed <br />$18,000.00 and is hereby appropriated from the Water Capital O.utlay & <br />Depreciation Fund. <br /> <br /> Section 3~ That this ordinance ls hereby declared to <br />be an emergency m~asure for the reasons stated in the preamble <br />hereof and provided zt recezves the affirmative vote of two-thirds <br />of all members elected to Council, it shall take effect and be <br />in force immediately upon its adoption and approval by the Mayor; <br />otherwise it shall take effect and be in force from and after <br />the earliest period allowed by law. <br /> <br /> /~ President <br /> Clerk/ <br /> <br /> <br />
