<br /> AN EMERGENCY ORDINANCE enacting new Subsection 513.01 (cc)
<br />of the General Offenses Code of the Codified Ordinance of the City
<br />of Lakewood and amending Section 513.O4 of the General Offenses Code
<br />of the Codified Ordinance of the City of Lakewood relating to the
<br />prohibiting of drug related paraphernalia.
<br />
<br /> WHEREAS, this Council has become aware of and is concerned over the
<br />general proliferation of "head shops" engaged in the sale of paraphernalia
<br />associated with drug use; and
<br />
<br /> WHEREAS, this Council finds that such establishments serve only to
<br />entice young people to abuse substances which are known to be harmful and
<br />unsafe for human consumption; and
<br />
<br /> WHEREAS, this Ordinance constitutes an emergency measure providing
<br />for the immediate preservation of the public safety and welfare and for
<br />the usual daily operation of a municipal department; now, therefore,
<br />
<br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO:
<br />
<br /> Section 1. That the General Offenses Code of the Codified Ordinance
<br />of the City of Lakewood be supplemented by an acting new Subsection 513.OI
<br />(cc) of the General Offenses Code of the Codified Ordinance of the City
<br />of Lakewood which shall read as follows:

<br />513oO1 DEFINITIONS.

<br />"Drug Paraphernalia" means all equipment, products and
<br />materials of any kind which are used, intended for use,
<br />or designed for use, in planting, propagating, cultivating,
<br />growing, harvesting, manufacturing, compounding, convert-
<br />ing, producing, processing, preparing, testing, analyzing;
<br />packaging, repackaging, storing, containing, concealing,
<br />injecting, ingesting, inhaling, or otherwise introducing
<br />into the human body a controlled substance in violation
<br />of this Chapter. It includes, but is not limited to:
<br />
<br />(Al Kits used, intended for use, or designed for use in
<br /> planting, propagating, cultivating, growing, or harvest-
<br /> ing of any species of plant which is a controlled sub-
<br /> stance or from which a controlled substance can be
<br /> derived;
<br />(B) Kits used, intended for use, or designed for use in
<br /> manufacturing, compounding, converting, producing,
<br /> processing, or preparing controlled substances;
<br />(C) Isomerization devices used, intended for use, or
<br /> designed for use in increasing the potency of any
<br /> species of plant which is a controlled substance;
<br />(D) Testing equipment used, intended for use, or designed
<br /> for use in identifying, or in analyzing the strength,
<br /> effectiveness or purity of controlled substances;
<br />(El Scales and balances used, intended for use, or
<br /> designed for use in weighing or measuring controlled
<br /> substances;
<br />(Fi Oiluents and adulterants such asquinine hydrochloride,
<br /> mannitol, mannite, dextrose and lactose, used, intended
<br /> for use, or designed for use in cutting controlled
<br /> substances;
<br />(Gl Separation gins and sifters used, intended for use,
<br /> or designed for use in removing twigs and seeds from,
<br /> or in otherwise cleaning or refining, marijuana;
<br />(Hi Blenders, bowls, containers, spoons and mixing devices
<br /> used, intended for use, or designed for use in compound-
<br /> ing controlled substances;
