ORDINANCE NO. ] 0- 80 BY: Gallagher, Graham, McBride, Salmon, Wendling, Brown, Ch i nnock AN EME~CY ORDINANCE to amend Paragraph 313.02(a) and to enact new Paragraph 313.02(f) of the Traffic. Code of the Codified Ordinances of the City of Lakewood to remove the provision designating municipal streets that carry regularly scheduled bus routes as through highways and to declare certain residence streets not to be through higl~ways. WHEREAS, the Ohio Legislature recently adopted Amended House Bill 290, effective January 10, 1980, whereby Ohio Revised Code Section 4511.65 was amended to remmve the provision designating municipal streets that carry regularly scheduled bus routes as through highwasy thereby reducing the speed limit on such streets that are not also state rou~es or have not otherwise been designated as through highways from 35 to 25 miles per hour. WHEREAS, this Council desires to amend the Traffic Code of the Codified Ordinances of the City of Lak~vood to conform to the new state provisions, and WHEREAS, pursuant to the aforementioned amendment to the Traffic Code, it is now property for the City to designate by ordinance streets in residence districts not to be through highways, and WHEREAS, this ordinance constitutes an emergency measure providing for the inmediate preservation of the public safety and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Paragraph 313.02(a) of the Traffic Code of the Codified Ordinances of the City of Lak~vood now reading as follows: 313.02 THROUGH STREETS; STOP SIGNS AND INTERSECTI(I~S. (a) Ail state routes and all sections of streets on which are operated motor coaches or buses for carrying passengers for hire along a fixed or regular route under authority granted by the City, and the following nan~d-streets and parts of streets are through highways: Franklin Boulevard from Warren Road east to West ll7th Street, Hilliard Road, Riverside Drive from' Detroit Avenue south to the City of Cleveland, Delaware Avenue, Lakewood Heights Boulevard from Berea Road west to Woodward Avenue, North Marginal Road, and South Marginal Road, are hereby designated as through highways provided that stop signs shall be erected by the Director of Public Safety at all intersections with such through highways excepting those intersections otherwise designated hereinafter as stop intersections. However, where two or more through highways intersect and no traffic control signal is in operation, stop signs shall be erected at one or more entrances thereto by the Director of Public Safety. (a) All state routes and the following n~r~d streets and parts of streets are hereby desig~nated as through highways: Franklin]~ Boulevard from Warren Road east to West ll7th Street, Hilliard Road, Riverside Drive from Detroit Avenue south to the City of CleVeland, Delaware Avenue, Lakewood Heights Boulevard from Berea Road est to Woodward Avenue, North Marginal Road, and South Marginal Road, are hereby desiganted as through highways provided that Stop signs shall be erected by the Director of Public Safety at all intersections with such through highways excepting those intersections otherwise designated hereinafter as stop
