<br /> AN E~RGENCY ORDINANCE authorizing and directing the Mayor,
<br />ex-officio Director of Public Safety, to enter into a mutual assistance contract
<br />with the cities of Bay Village, Ohio, Rocky River, Ohio, Fairview Park, Ohio,
<br />North Olmsted, Ohio and Westlake, Ohio for the purpose of providing for the
<br />interchange of the police personnel, police equipment and the police services of
<br />the police departments o£ said conrnunities, including participation in the
<br />Westshore Enforcement Bureau.

<br /> W~, Section 737.04 of the Ohio.Revised Code authorizes the
<br />legislative authority o£ a municipal corporation to enter into a contract with
<br />other municipal corporations upon such terms as are agreed upon £or services o£
<br />police departments or the use o£ police equipment or £or the interchange o£ such
<br />services or equipment within the several territories of the contracting sub-
<br />divisions, and
<br />
<br /> WHEREAS, effective October 26, 1979, the Ohio Legislature adopted
<br />Amended House Bill No. 279 which elirainated the three-year limitation on the
<br />duration of police protection contracts between municipalities, and
<br />
<br /> WHERF~S, the cities of Bay Village, Ohio, Lakewood, Ohio, Rocky River,
<br />Ohio, Fairview Park, Ohio, North Olmsted, Ohio snd Westlske, Ohio have previously
<br />entered into an agreement for the interchange of police personnel and the
<br />participation in the Westshore Enforcement Bureau and all of the other said
<br />cities are desirous of entering into a new agreement pursuant to authority of
<br />the new amended Section 737.04 of the Ohio Revised Code, and
<br />
<br /> WHEEEAS, such contracts must first be authorized by the respective
<br />legislative authorities, and
<br />
<br /> $~2~S, this ordinance constitutes an emergency measure providing for
<br />the inn~diate preservation, o£ the public peace, health, safety and welfare and
<br />£or the usual daily operation of a municipal department and for the further
<br />reason that the provision of mutual aid is determined to 'be in the best interests
<br />of the citizens of the City of Lakewood to insure adequate safety forces in the
<br />event circmrstances require the assistance of neighboring police personnel;

<br />BE IT ORDAINED BY THE OOUNCIL OF TIlE CITY OF LAKEWOOD, STATE OF
<br />
<br /> Section 1. That the Mayor, ex-o£ficio Director of Public Safety, be
<br />and he is hereby authorized and directed to enter into a mutual assistance
<br />contract £or the interchange of police personnel, police equipment and the police
<br />services of the police departments of the cities of Bay Village, Ohio, Rocky
<br />River, Ohio, Fairview Park, Ohio, North Olmsted, Ohio and Westlake, Ohio, including
<br />participation in the Westshore Enforcement Bureau, said contract being substantially
<br />in the form as set £orth in Exhibit A attached, hereto, and made a part hereo£.
<br />
<br /> Section 2. That this ordinance is hereby declared to be an emergency
<br />measure for the reason~ stated in the preamble hereof and provided it receives the
<br />affirmative vote of two-thirds o£ all members elected to Council, it shall tske
<br />effect and be in force irm~diately upon its adoption and approval by the Mayor,
<br />otherwise it shall take effect and be in force from and after the earliest period
<br />
<br />allowed by law.
