ORDINANCE NO. 48-80 BY: McBride, Salmon, Wendling, Brown Chinnock, Gallagher, Graham AN EMERGENCY ORDINANCE to amend SeCtion 1323.01(c) and Section 1323.O5 of Chapter 1323 of the Building Code of the Codified Ordinances of the City of Lakewood relating to the registration of contractors. WHEREAS, this Ordinance constitutes an emergency measure provising for the immediate preservation of the public safety and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 1323.O1(c) of the Building Code o~ the Codified Ordinances of the City of Lakewood, now reading as follows: 1323.O1 REGISTRATION REQUIREMENT Section (c) c) Contractor, for the purpose of this section, means any person, corporation, partnership, firm or other business associa- tion who performs any work specified above for consideration evidenced by an oral or written agreement. No corporation, part- nership, firm or other business association shall engage in work for which a Certificate of Registration is required, unless at least one responsible member, officer or employee of such corporation, partnership, firm or other business association has been registered pursuant to this Chapter. All work performed by such corporation, partnership, firm or other business association shall be under the direct supervision of the registered person. be and the same is hereby amended to read as follows: 1323.O1 REGISTRATION REQUIREMENT;Section (c) c) Contractor, for the purpose of this section, shall mean any person, corporation, partnership, firm or other business association who performs any work specified above for consideration evidenced by an oral or written agreement. Contractor, for purposes of this section, shall also mean any person, firm, corporation or other business association which negotiates a contract either written or oral for any work specified above, but does not perform physical labor to complete the work as set forth in the contract. No corporation, partnership, firm or other business association shall engage in work for which a Certificate of Registration is required, unless at least one 'responsible member, officer or employee of such corporation, partnership, firm or other business association has been registered pursuant to this Chapter. All work performed by such corporation, partnership, firm or other business association shall be under the direct supervision of the registered person. Section 2. That Section 1323.O5 of the Building Code of the. Codified Ordinances of the Cit~ of Lakewood now reading as follows: 1323.05 BOND When evidence discloses that the registrant has refused, failed or neglected to correct or abate violations of any a'ppli- cable cpde or ordinance in performance of work done pursuant to a certificate of registration within a reasonable time after having been notified by the Building Commissioner, the Building Commissioner may require the registrant to furnish a performance ,bond in the amount of Five Thousand Dollars ($5,000.OO) guaranteeing
