ORDINANCE NO. 55-80 BY: Graham, McBride, Salmon, Wendling, Brown, Chinnock, Gal 1 agher AN EMERGENCY ORDINANCE to amend Section 541.07 of the General Offenses Code of the Codified Ordinances of the City of Lakewood so as to include damage to the nationality trees situated in Lakewood Park. WHEREAS, on April 25, 1980 the City dedicated the seven'nationality trees planted in Lakewood Park, and WHEREAS, it is the intention of the City to continue to plant up to twenty or more trees to represent and commerate the nationalities represented by the citizens of the City of Lakewood, and' WHEREAS, it is the opinion of this Council that additional protection will be offered to these symbolic ~rees by providing for a more severe penalty than is provided for the destruction of regular trees under Section 541.06 of the Codified Ordinances of the City of Lakewood, and WHEREAS, this ordinance constitutes an emergency measure providing for the inrnediate preservation of the public safety and welfare and for the usual daily operation of a municipal department; now, therefore, o. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 541.07 of the General Offenses Code of the Codified Ordinances of the City of Lakewood now reading as follows: 541.07 DESECRATION. (a) No person, without privilege to do so, shall purposely deface, damage, pollute or otherwise physically mistreat any of the following: (1) The flag of the United States or of this State; (2) 'Any public monument; (3) Any historical or commenorative marker, or any (b) structure, Indian mound or earthwork, thing or site of great historical or archaeological interest; (4) A place of worship or its furnishings; (5) A work of art or museum piece; (6) Any other object of reverence or sacred devotion; Whoever violates this section is guilty of desecration, a misdemeanor of the second degree. be and the same is hereby amended to read as follows: 541.07 DESECRATION.
