ORDINANCE NO. 63-80 BY: Graham, McBride, Salmon, <br /> BroWn, Chinnock, <br /> <br /> AN-EMERGENCY ORDINANCE authorizing the Mayor to make application to the <br />Environmental Protection Agency for a Step-II Grant Amendment to obtain additional <br />soil borings along the path of the new outfall sewer, to accept same and to enter <br />into a contract with Watermation, Incorporated to perform said additional work. <br /> WHEREAS, it is necessary for the City to comply with Public Law 92-500, <br />the Federal Water Pollution Control Act, and <br /> WHEREAS, the City of Lakewood has received a Step-II grant from the <br />Environmental Protection Agency for the detailed design of necessary improvements <br />in the City's wastewater treatment facilities, and <br /> WHEREAS, the United States Army Corp of Engineers has reviewed the plans <br />and specifications produced by this Step-II grant effort and has strongly recommended <br />that additional soil borings be taken, and <br /> WHEREAS, the Environmental Protection Agency has advised the City that <br /> additional Step-II funding can be made available upon application to undertake this <br /> additional work and this Council is of the opinion that it is in the best interests <br /> of the City to undertake this additional work, and <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br /> the usual daily operation of a municipal department and for the further reason <br /> that it is in the best interests of the public health, safety and welfare to <br /> proceed with the Step-II work relating to the City's wastewater treatment <br /> facilities without delay; now, therefore, <br /> BE IT ORDA~INED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: ..... <br /> Section 1. That the Mayor be and he is hereby authorized and directed <br /> to make application to the Environmental Protection Agency for a Step-II Grant <br /> Amendment in the amount of $39,560.00 to cover the federal 75% share of the <br /> estimated cost for additional soil borings and related work as recommended by the <br /> United States .Army Corp of Engineers. <br /> Section 2. That the Mayor be and he is hereby authorized and directed <br /> upon approval of the aforementioned Step-II Grant Amendment by the Environmental <br /> Protection Agency to accept said Grant Amendment and to enter into a contract with <br /> the firm of Watermation, Incorporated, 2304 University Avenue, St. Paul, Minnesota, <br /> as consulting engineers for the purpose of performing the necessary soil borings <br /> and ancillary work as recommended by the United States Army Corp of Engineers. <br /> Section 3. That the City's 25% share of the total cost of the afore- <br /> mentioned additional work is estimated at $13,186.00 and that the funds for this <br /> work are to be provided by the Wastewater Sewer Facility Fund. <br /> Section 4. It is found and determined that all formal actions of this <br /> Council concerning and relating to the passage of this ordinance were adopted in <br /> an open meeting of this Council, and that all such deliberations of this Council <br /> and of any of its committees that resulted in such formal action, were in meetings <br /> open to the public, in accordance with all legal requirements including Section <br /> 121.22 of the Ohio Revised Code. <br /> Section 5. That this ordinance is hereby declared to be an emergency <br /> measure for the reasons stated in the preamble hereof and provided it receives the <br /> affirmative vote of two-thirds of all members elected to Council, it shall take <br /> effect and be in force immediately upon its adoption and approval by the Mayor; <br /> otherwise it s~all take effect and be in force from and after the earliest period <br /> <br /> -j' y/ ~res'i d ' <br /> <br /> Approved:__ /~/'/~f~ <br /> <br /> <br />
