ORDINANCE NO. 63-80 BY: Graham, McBride, Salmon, BroWn, Chinnock, AN-EMERGENCY ORDINANCE authorizing the Mayor to make application to the Environmental Protection Agency for a Step-II Grant Amendment to obtain additional soil borings along the path of the new outfall sewer, to accept same and to enter into a contract with Watermation, Incorporated to perform said additional work. WHEREAS, it is necessary for the City to comply with Public Law 92-500, the Federal Water Pollution Control Act, and WHEREAS, the City of Lakewood has received a Step-II grant from the Environmental Protection Agency for the detailed design of necessary improvements in the City's wastewater treatment facilities, and WHEREAS, the United States Army Corp of Engineers has reviewed the plans and specifications produced by this Step-II grant effort and has strongly recommended that additional soil borings be taken, and WHEREAS, the Environmental Protection Agency has advised the City that additional Step-II funding can be made available upon application to undertake this additional work and this Council is of the opinion that it is in the best interests of the City to undertake this additional work, and WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department and for the further reason that it is in the best interests of the public health, safety and welfare to proceed with the Step-II work relating to the City's wastewater treatment facilities without delay; now, therefore, BE IT ORDA~INED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: ..... Section 1. That the Mayor be and he is hereby authorized and directed to make application to the Environmental Protection Agency for a Step-II Grant Amendment in the amount of $39,560.00 to cover the federal 75% share of the estimated cost for additional soil borings and related work as recommended by the United States .Army Corp of Engineers. Section 2. That the Mayor be and he is hereby authorized and directed upon approval of the aforementioned Step-II Grant Amendment by the Environmental Protection Agency to accept said Grant Amendment and to enter into a contract with the firm of Watermation, Incorporated, 2304 University Avenue, St. Paul, Minnesota, as consulting engineers for the purpose of performing the necessary soil borings and ancillary work as recommended by the United States Army Corp of Engineers. Section 3. That the City's 25% share of the total cost of the afore- mentioned additional work is estimated at $13,186.00 and that the funds for this work are to be provided by the Wastewater Sewer Facility Fund. Section 4. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in accordance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 5. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise it s~all take effect and be in force from and after the earliest period -j' y/ ~res'i d ' Approved:__ /~/'/~f~
