ORDINANCE NO. 68-80 BY: Gallagher, Graham, McBride, Salmon, Brown, Chinnock AN EMERGENCY ORDINANCE authorizing and directing the Mayor to exercise the option granted pursuant to Ordinance No. 27-80 and to purchase real estate known as permanent parcel number 311-14-41 in Lakewood, Ohio, hereinafter more particularly described and subject to the terms and conditions hereinafter set forth. WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public hea~th and welfare and for the usual daily operation of a municipal department and for the further reason that the owners have agreed to sell said property for the consideration herein stipulated and this Council determines it to'be in the best interest of the City that the property be purchased immediately so that the construction of the Sloane Avenue Park can be commenced without any further delay; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section l. That the Mayor be and he is hereby authorized and directed to purchase from James and Marcia Pfaff the following described property: Situated in the City of Lakewood, County of Cuyahoga and State of Ohio: and known as being the premises located at the point of intersection of Sloane and Edanola Avenues, and being all of Sublot No. 52, in the Mathews and Gilbert Highbridge Park Subdivision No. 4, a resubdivision of part of the Clifton Park Association allotment, of part of section 23, Rockport Township, as recorded in Volume 9 of Maps, Page 38 of Cuyahoga County Records, as shown by the recorded plat thereof in Volume 30 of Maps, Page lO of Cuyahoga County Records, and bounded and described as follows: beginning at a point on the easterly side of Sloane Avenue, at the northwesterly corner of Sublot No. 52; thence southerly along said easterly line of Sloane Avenue, 90 feet to a curved turnout between the easterly line of Sloane Avenue, and the northwesterly line of Edanola Avenue; thence southeasterly along said curved turnout 38.70 feet to a point in the northwesterly line of Edanola Avenue; thence northeasterly along said northwes- terly line of Edanola Avenue 90 feet to the most easterly corner of said Sublot No. 52; thence northwesterly along the northeasterly line of said Sublot No. 52, 45.37 feet to the most northerly corner of said Sublot No. 52; thence westerly along the nor'therly line of said Sublot No. 52, 45.37 feet, to the place of beginning, be the same more or less, but subject to all legal highways. and to pay therefor the sum of Thirty Five Thousand Dollars ($35,000.00). Section 2. That the title to said property shall be subject to the approval of the Director of Law; that taxes and assessments and rental income shall be prorated as of the date of the filing of' the Deed for record using the last available tax rate and valuation for computing tax prorations; that the Director of Finance be and he is hereby authorized to pay the amount set forth in Section 1 hereof from the 1980 Community .Development Funds upon delivery by the Grantor of a good and sufficient Warranty Deed to the City of Lakewood, together with guarantee of title disclosing the said real estate to be free and clear of all encumbrances excepting taxes and assessments not yet due and payable, zoning ordinances and restrictions of record, if any; and that the Director of Finance be and he is hereby authorized to pay all expenses incidental to the transfer of title pursuant to the Uniform Relocation Act and Real Property Acquisition Policies Act of 1970 (PL 91-646).
