ORDINANCE NO. 68-80 <br /> <br />BY: Gallagher, Graham, McBride, <br /> Salmon, Brown, Chinnock <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor to exercise <br />the option granted pursuant to Ordinance No. 27-80 and to purchase real estate <br />known as permanent parcel number 311-14-41 in Lakewood, Ohio, hereinafter <br />more particularly described and subject to the terms and conditions hereinafter <br />set forth. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />the immediate preservation of the public hea~th and welfare and for the usual <br />daily operation of a municipal department and for the further reason that the <br />owners have agreed to sell said property for the consideration herein stipulated <br />and this Council determines it to'be in the best interest of the City that the <br />property be purchased immediately so that the construction of the Sloane Avenue <br />Park can be commenced without any further delay; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section l. That the Mayor be and he is hereby authorized and directed <br />to purchase from James and Marcia Pfaff the following described property: <br /> <br /> Situated in the City of Lakewood, County of Cuyahoga and <br />State of Ohio: and known as being the premises located at the <br />point of intersection of Sloane and Edanola Avenues, and being <br />all of Sublot No. 52, in the Mathews and Gilbert Highbridge Park <br />Subdivision No. 4, a resubdivision of part of the Clifton Park <br />Association allotment, of part of section 23, Rockport Township, <br />as recorded in Volume 9 of Maps, Page 38 of Cuyahoga County Records, <br />as shown by the recorded plat thereof in Volume 30 of Maps, Page <br />lO of Cuyahoga County Records, and bounded and described as <br />follows: beginning at a point on the easterly side of Sloane <br />Avenue, at the northwesterly corner of Sublot No. 52; thence <br />southerly along said easterly line of Sloane Avenue, 90 feet to <br />a curved turnout between the easterly line of Sloane Avenue, and <br />the northwesterly line of Edanola Avenue; thence southeasterly <br />along said curved turnout 38.70 feet to a point in the northwesterly <br />line of Edanola Avenue; thence northeasterly along said northwes- <br />terly line of Edanola Avenue 90 feet to the most easterly corner <br />of said Sublot No. 52; thence northwesterly along the northeasterly <br />line of said Sublot No. 52, 45.37 feet to the most northerly <br />corner of said Sublot No. 52; thence westerly along the nor'therly <br />line of said Sublot No. 52, 45.37 feet, to the place of beginning, <br />be the same more or less, but subject to all legal highways. <br /> <br />and to pay therefor the sum of Thirty Five Thousand Dollars ($35,000.00). <br /> <br /> Section 2. That the title to said property shall be subject to the <br />approval of the Director of Law; that taxes and assessments and rental income <br />shall be prorated as of the date of the filing of' the Deed for record using the <br />last available tax rate and valuation for computing tax prorations; that the <br />Director of Finance be and he is hereby authorized to pay the amount set forth <br />in Section 1 hereof from the 1980 Community .Development Funds upon delivery by <br />the Grantor of a good and sufficient Warranty Deed to the City of Lakewood, <br />together with guarantee of title disclosing the said real estate to be free and <br />clear of all encumbrances excepting taxes and assessments not yet due and payable, <br />zoning ordinances and restrictions of record, if any; and that the Director of <br />Finance be and he is hereby authorized to pay all expenses incidental to the <br />transfer of title pursuant to the Uniform Relocation Act and Real Property <br />Acquisition Policies Act of 1970 (PL 91-646). <br /> <br /> <br />
