Chi nnock, <br />Gallagher <br /> <br />AN EMERGENCY ORDINANCE to supplement Chapter 1327 - Condominiums _ of <br />the 8uilding Code ,of the Codified Ordinances of the City of lakewood by enacting <br />new Subsection 1327.06(0) to provide relocation assistance to certain groups <br />of tenants facing eviction due to conversion of their rental units to condominiums. <br /> <br />WHEREAS, many rental, housing units have been removed from the rental <br />market trrrough conversion to condominiums and tenants who are evicted due to <br />conversiofl are experiencing serious difficulties in locating comparable rental <br />housi ng, and <br /> <br />WHEREAS, these difficulties are particularly acute for elderly tenants <br />and those with physical limitations, particularly the handicapped and disabled <br />as well as those tenants who have occupied their rental units for a significant <br />period of time, and <br /> <br />WHEREAS, the City's current Condominium ordinance addresses the grave <br />;public health and welfare problems in the context of new conversions and rental <br />units but does not provide assistance to tenants di"splaced due to the conversion <br />of their rental units to condominiums, and <br /> <br />WHEREAS, this Cauncil is of the opinion that the conversion of rental <br />units to condominiums cause rental housing shortages and further finds and <br />declares that it would be just and proper for the developer who enjoys the <br />benefits of such conversion to assist certain groups of tenants who are displaced <br />by the conversion. activity and who otherwise would be forced to bear the burdens <br />of displacement without any assistance, and < <br /> <br />WHEREAS, this ordinance is declared to be an emergency measure for the <br />reason that the number of apartments being removed from the rental market are <br />rapidly increasing and rental assistance should be made available at the earliest <br />possible time and for the further reason that the ordinance provides for the <br />immediate preservation of the public welfare; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF lAKEWOOO, STATE OF OHIO: <br /> <br />Section 1. That Chapter 1327 of the .8uilding Code of the Codified <br />Ordinànces of the City of lakewood shall bè and the same is hereby supplemented <br />by enacting new Subsection 1327.06(0) to read as. follows: <br /> <br />1327.06 PROTECTION OF TENANTS AND PURCHASERS. <br /> <br />(a) Relocation Assistance <br /> <br />(1) A relocation assistance shall be paid by the devéloper <br />ta qualifying tenants and subtenants who vacate their <br />renta 1 units either vol untarily or involuntarily after <br />receiving the notice of conversion pursuant to Subsection <br />(b) hereof in accordance with the following schedule: <br /> <br />TENANT UNDER 60 YEARS OF AGE, TENANT OVER 60 YEARS OF AGE,OR <br />YEARS OF OR DEAF, OR BLIND, OR UNA8LE TO DEAF, OR 8LINO, OR UNA8lE TO <br />CONTINUOUS OCCUPANCY· WALK WITHOUT ASSISTANCE WALK WITHOUT ASSISTANCE <br /> <br />Under 5 years <br />5 to 10 years <br /> <br />No Assistance 1 month's rent <br />1 month's rent 2 month's rent <br />2 month IS rent 3 month's rent <br /> <br />Over 10 years <br />
