ORDINANCE NO. 75-80 <br /> <br />BY: Gallagher, Graham, McBride, <br /> Salmon, Wendling, Brown,Chinnock <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor to execute a Step III - <br />Phase I Grant Agreement with the Environmental Protection Agency and to enter <br />into a contract with Watermation, Incorporated for engineering services necessary <br />for the Step III work to construct the Phase I improvements in the Lakewood <br />Wastewater Treatment Plant and its ancillary systems in accordance with the <br />Lakewood Facility Plan. <br /> <br /> WHEREAS, it is necessary to comply with Public Law 92-500, the <br />Federal Water Pollution Control Act, and <br /> <br /> WHEREAS, the City of Lakewood has received a Step II Grant from the <br />Environmental Protection Agency for detail design to upgrade the City's wastewater <br />treatment facilities, and <br /> <br />WHEREAS, the first phase of the Step II design work has been completed, <br /> <br />and <br /> <br /> WHEREAS, detail specifications and drawings produced in the Step II <br />activity have been approved by the Environmental Protection Agency, and <br /> <br /> WHEREAS, the Environmental Protection Agency has advised the City that <br />a Step III Grant sufficient to cover the federal 75% share of the Phase I <br />portion of the Step III work is now available and the Grant Agreement must be <br />executed by the City and returned to the Environmental Protection Agency without <br />further delay, and <br /> <br /> WHEREAS, the firm of Watermation, Incorporated has performed all <br />Step I and Step II work for the City of Lakewood in a satisfactor manner and has <br />submitted a proposed contract between the City of Lakewood and Watermation, <br />Incorporated to perform Step III engineering services as a part of our Step III <br />Grant Application, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for th~ immediate preservation of the public health, safety and welfare and for <br />the further reason that it is in the interest of the public service, welfare and <br />safety to proceed with the Step III work relating to our wastewater treatment <br />plant and ancillary systems at the earliest possible time; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby authorized and directed <br />to execute a Step III, Phase I Grant Agreement in the amount of $13,410,825.00 with <br />the Environmental Protection Agency and employ by contract the firm of Watermation, <br />Incorporated, 2304 University Avenue, St. Paul, Minnesota as consulting engineers <br />for the purpose of performing engineering services necessary for the Step III work <br />to construct the Phase I improvements in the Lakewood Wastewater Treatment Plant <br />and its ancillary systems in accordance with the Lakewood Facility Plan, the <br />amount of said engineering services contract to be $725,214.00. <br /> <br /> Section 2. That the City of Lakewood's 25% share of the total cost for <br />this work is estimated at $4,470,275.00, and the funds for this work are to be <br />provided by the Wastewater Sewer Facility Fund. <br /> <br /> Section 3. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted <br />in an open meeting of this Council, and that all such deliberations of this <br />Council and of any of its committees that resulted in such formal action, were <br />in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> <br />
