ORDINANCE NO. 9- 8] BY~ Brown, Chinnock, <br /> Gallagher, Graham, <br /> McBride, Salmon, <br /> Wend 1 ing <br /> <br /> ~N EMERGENCY ORDINANCE authorizing the City Engineer to enter into a <br />contract with Adachi, Ciuni and Lynn for a structural analysis of the existing <br />bridge on Metropolitan Park Road adjacent to the l~ke%vood Wastewater Treatment <br />Plant. <br /> <br /> WHEREAS, it is incumbent upon the City to cor~ply with Public Law 92-500, <br />the Federal Water Pollution Control Act, and <br /> <br /> Wt{ERF~iS, the City has received a Step III grant from the Environmental <br /> Protection Agency in the amount of 75% of the construction and related costs of <br />t he Phase I improvements of the City's wastewater treatment facility, and <br /> <br /> WHEREAS, the construction of these Phase I improvaments require the <br />transport of HS-20 Class Loadings across the bridge on Metropolitan Park Road, and <br /> <br /> WHEREAS, the continuing operation of our wastewater treatment facilities <br />also requires the transport of HS-20 Class Loadings across the aforesaid bridge, and <br /> <br /> WHEREAS, the Cleveland Metropolitan Park System has challenged our use of <br />this bridge for HS-20 Class Loadings, and <br /> <br /> WHEREAS, an agreement must be reached between the City and Cleveland <br />Metropolitan Park System regarding future use of this bridge both for construction <br />of the new facilities and for continued operation of the existing wastewater <br />facilities, and <br /> <br /> WHEREAS, it is imperative that a detailed structural analysis of the <br />existing bridge be obtained without delay to arrive at an agreement with the <br />Cleveland Metropolitan Park System as to ~he allowable loading on the bridge and <br />the probable effect of heavy loads on the life of the bridge prior to advertising <br />for bids for the aforementioned improvements; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the City Engineer be and he is hereby authorized and <br />directed to enter into a contract with Adachi, Ciuni and Lynn, Cleveland, Ohio for <br />a detailed structural analysis of the existing bridge on Metropolitan Park Road <br />adjacent ~o the Lakewood Wastewater Treatment Plant to determine maximum load, <br />establish a safe load limit, determine the expected life of the bridge due to <br />loads analyzed, and ~o identif~ any overload capacity of the bridge. <br /> <br /> Section 2. That the total cost of this structural analysis shall be the <br />direct labor costs plus the allowable overhead and fringe benefits and profit, and <br />shall not exceed $5,000.00. Funds for this analysis shall be provided from the <br />Wastewater Sewez- Facility Fund. <br /> <br /> Section 3. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance are adopted at an <br />open meeting of this Council, and that all such deliberations of this Council and <br />any of its conTaittees that resulted in such formal action were meetings that were <br />open to the public in compliance with all legal requirements including Section <br />121.22 of the Ohio Revised Code. <br /> <br /> Section 4. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preant31e hereof and provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, it shall take <br />effect and be in force inn~diately upon its adoption and approval by the Mayor; <br />otherwise it shall take effect and be in force after the earliest period allowed by <br />law. <br /> <br /> %/ ~ Presiaen~ <br /> <br /> <br />
