ORDINANCE NO. 103-81 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE authorizing and directing the Mayor to purchase certain real property located at 1462 Belle Avenue hereinafter more particularly described. WHEREAS, the Hospital Board of Trustees five-year plan included a recommendation that suitable property in the Hospital vicinity be acquired as it becomes available for future requirements of the Hospital's present programs and facilities, and WHEREAS, the Hospital Administration has established a property acquisi- tion policy which requires consultation with the Mayor, Chairman of the Hospital Board of Trustees' Finance Committee and the Chairman of the City Council Hospital Committee prior to an offer being made by the Hospital to the property owner, and WHEREAS, an approved offer was made to the property owners and said property owners have accepted same, and WHEREAS, the Board of Trustees of Lakewood Hospital by Resolution 603, adopted October 27, 1981 requested Council adopt appropriate legislation authorizing the acquisition of the subject property for future Hospital expansion, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public safety and welfare, and for the usual daily operation of a municipal department and for the further reason that the owners have agreed to sell said property for the consideration herein stipulated and this Council determines it to be in the 'best interest of the City that the property be purchased as soon as possible. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor be and he is hereby authorized and directed to purchase from Paul A. Shannon and Joyce L. Shannon the following described property: Situated in the City of Lakewood, County Of Cuyahoga and State of Ohio and known as being Sublot No. 15 in Belle Avenue Allotment of part of original Rockport Township, Section No. 22 as shown by the recorded plat in Volume 41 of Maps, page 23 of Cuyahoga C~unty~ Records, and being 43 feet front on the westerly side of Belle Avenue and extending back 162.68 feet on the northerly line, 162.80 on the southerly line and having a rear line of 45.01 feet as appears by said plat be the same more or less, but subject.to all legal high- ways. and to pay therefor the sum of Seventy Four Thousand, Five Hundred Dollars, ($74,500.00) Section 2. That the title to said property shall be subject to the approval of the Director of Law; that taxes and assessments shall be' pro. rated as of the date of the filing of the Deed for record using the last available tax rate and valuation for computing tax prorations; that the Direc- tor of Finance be and he is hereby authorized to pay the amount set forth in
