ORDINANCE NO. 14-81 BY: Brown, Chinnock, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE authorizing the Mayor on behalf of the City of Lakewood to enter into sm Easement Agreement with the Board of Park Conmissioners of the Cleveland Metropolitan Park District for the use of the driveway leading from the Metropolitan Park drive to the Lakewood Wastewater Treatment Plant. WHEREAS, over the years, the City has used property owned by the Board of Park Conntissioners of the Cleveland Metropolitan Park District (Metro Parks) as a means of ingress and egress from the Metro Parks drive to the Lakewood Wastewater Treatment Plant, and WHEREAS, in conjunction with the upgrad'~ng of our wastewater facilities, it is necessary that said driveway be improved to handle a higher traffic density, smd %~IF/REAS, in 'view of the contemplated increase in use of said driveway, Metro Parks has requested That a formal Easement Agreement be entered into by and between the Metropolitan Park System and the City, and WHEREAS, negotiations have been conducted with representatives of the Metropolitan Park System regarding said easement, and WHEREAS, it is in the best interests of the City that it enter into an Easement Agreement with Metro Parks for ~he use and maintenance of said driveway, and WI{ERFAS, this ordinance constitutes sm emergency measure providing for the usual daily operation of a municipal department and for the further reason that the improvements 5o the Wastewater Treatment Plant should be finalized at the earliest possible time; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKASVCOD, STATE OF OHIO: Section 1. That the Mayor, on behalf of the City of Lakewood, be and he is hereby authorized and directed to enter into sm Easement Agreement with the Board of Park Conmissioners of the Cleveland Metropolitan Park District, Cleveland, Ohio for the use of the driveway leading from the Metropolitan Park drive to the Lakewood Waste~vater Treatment Plant, said Easement Agreement to be substantially in the form as sez forth in Exhibit A, attached hereto and made a part hereof. Section 2. It is found smd determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of this Council, and that all said deliberations of this Council and that of any of its conraittees that resulted in such formal action, were in meetings open to the public in accordance with all legal requirements including Section 121.22 of 'the Ohio Revised Code. Section 3. That this Ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all 2~Tbers elected to Council, it shall take effect and be in force immediately upon its adoption smd approval by the Mayor; .otherwise it shall take effect and be in force from and after the earliest period allowed by law.
