ORDINANCE NO. 21-81 <br /> <br />BY: Brown, Chinnock, Gallagher <br /> Graham, McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE approving a Collective Bargaining Agreement <br />with Ohio Council 8 and Local 1043 of the American Federation of State, County <br />and Municipal Employees AFL-CIO establishing conditions of employment, working <br />conditions and various benefits for certain employees of the Department of <br />Public Works of the City of Lakewood and authorizing the Mayor to sign said <br />Agreement on behalf of the City. <br /> <br /> WHEREAS, a prior Collective Bargaining Agreement entered into between <br />the City of Lakewood and Ohio Council 8 and Local 1043 of the American Federa- <br />tion of State, County and Municipal Employees AFL-CIO terminated on February <br />28, 1981, and <br /> <br /> WHEREAS, discussions and negotiations have been continued subsequent <br />on behalf of the City with representatives of Local Union 1043 and Ohio Council <br />8 with respect to conditions of employment, working conditions, and various <br />benefits for certain employees of the Department of Public Works of the City of <br />Lakewood, and <br /> <br /> WHEREAS, agreement has been reached in the course of said discussions <br />and negotiations with respect to the conditions of employment, working conditions <br />and various benefits for certain employees aforementioned, and <br /> <br /> WHEREAS, this Council determines that it is in the best interest of <br />the City to approve said Collective Bargaining Agreement and authorize the <br />Mayor to sign same on behalf of the City, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety and welfare and for <br />the usual daily operation of a municipal department, and for the further reason <br />that it is necessary to approve said Agreement at the earliest possible time, <br />now, therefore, <br /> <br />BE tT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Collective Bargaining Agreement with Ohio Council <br />8 and Local 1043 of the American Federation of State, County and Municipal <br />Employees AFL-CIO, and effective for the period March 1, 1981, to February 28, <br />1983, an original copy of which is on file in the Office of the Mayor of the <br />City of Lakewood and is made a part hereof as though written fully herein, is <br />hereby adopted, ratified and approved and the Mayor is hereby authorized and <br />directed for and on behalf of the City of Lakewood to affix his signature there- <br />to. <br /> <br /> Section 2. That all other ordinances or resolutions or parts of <br />ordinances or resolutions which are inconsistent with the provisions of this <br />ordinance and/or the Collective Bargaining Agreement made a part hereof, are <br />hereby repealed as of March 1, 1981, to the extent that they pertain to the <br />employees in the bargaining unit covered by the Collective Bargaining Agreement <br />and are inconsistent with this ordinance, including the Collective Bargaining <br />Agreement referred to herein and made a part hereof. <br /> <br /> Section 3. It is found and determined that all formal actions of <br />this Council concerning and relating to the adoption of this resolution were <br />adopted in an open meeting of this Council, and that all such deliberations <br />of this Council and of any of its committees that resulted in such formal action <br />were in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> <br />
