ORDINANCE NO. 43-81 BY: <br /> <br />Brown, Chinnock, Gallagher <br />Grab~. McBride, Salmon <br /> <br />AN EMERGENCY ORDINANCE authorizing the Mayor to enter into an agreement <br />with the Ohio Department of Natural Resources to accept one third grant <br />for a private breakwall (not to exceed $100,000) for the preventing, <br />correcting and arresting of lake shore erosion. <br /> <br />WHEREAS, that pursuant to Resolution No. 5491, Lakewood City Council did <br />authorize the Mayor to make application for said funds to benefit certain <br />Lakewood property owners, and <br /> <br />WHEREAS, said property owners have petitioned the City to act with the <br />State, for the purpose of constructing a precast concrete breakwalt along <br />the shoreline for protection of their properties from erosion, and <br /> <br />WHEREAS, funds for the State's share of the construction costs are avail- <br />able in the State Treasury, special account, and <br /> <br />WHEREAS, this Ordinance constitutes an emergency measure in that it provides <br />for the immediate preservation of the public health, safety and welfare; <br />and for the further reason that this ordinance must be immediately effective <br />to prevent the erosion of properties within the City which could endanger <br />the health md safety of residents of the City by severing water mains and <br />sewers, collapsing houses and blocking streets, now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That the Mayor be and he is hereby authorized and directed to <br />enter into an agreement with the Ohio Department of Natural Resources to <br />accept a grant for one-third of the cost of the construction of a breakwall <br />(not to exceed $100,000) for the preventing, correcting and arresting of <br />lake shore erosion along certain shoreline of Lake Erie. Such agreement <br />shall be substantially in the form attached hereto as Exhibit A. <br /> <br />Section 2. That this ordinance is hereby declared to be an emergency <br />measure and provided it receives the affirmative vote of two-thirds of all <br />members elected to council, it shall take effect and be in force immediately <br />upon its adoption and approved by the Mayor. <br />Adopted.: ~L~6x~Q ]~"f / ~/ President <br /> <br />Approved: <br /> <br /> <br />
