ORDINANCE NO. 52-81 <br /> <br />BY: Brown, Chinnock, Gatlagher, <br /> Graham, McBride, Salmon, <br /> Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing the City Engineer to enter into <br />a contract with Watermation, Incorporated for the preparation, submittal, and <br />expediting of a Step Ill Grant Application. <br /> <br /> WHEREAS, the City of Lakewood has contracted with Watermation, Inc. <br />for the preparation of plans and specifications for the final, Phase ~ portion <br />of the upgrading of our wastewater facilities utilizing 75% federal funds re- <br />ceived as an EPA Step II Grant, and <br /> <br /> WHEREAS, these plans and specifications are n~aring completion and <br />will be ready for submittal to the EPA in Juty 1981, and <br /> <br /> WHEREAS, the City has been advised by the EPA that funds are avail~;Dle <br />for a 75% Step Ill Grant for construction of these Phase 2 fac'illties, and <br /> <br /> WHEREAS, a Step Ill Grant Application must be submitted to t~ie EPA <br />in order to receive the aforementioned funds, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety, and welfare and <br />for the further reason that it is in the interest of th~ public service, welfare <br />and safety to proceed with the Step Ill Grant, Phas~ 2 work relating to the up- <br />grading of our wastewater treatment plant and an~i~llary systems at the earliest <br />possible time; now, therefore, <br /> <br /> BE IT ORDAINED BY THE CO~3NCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. ThatQ~ City Engineer be and he is hereby authorized and <br />directed to enter into a contract with Watermation, Incorporated, St. Paul, <br />Minnesota, to pr~are and submit a Step Ill Grant Application and expedite its <br />review an0 approval by the EPA. <br /> <br /> Section 2. That the terms of this contract shall be reimbursement of <br />actual costs incurred by Watermation, Inc. in pursuing the work described above <br />with no additional fee, and with a not-to-exceed maximum reimbursement of <br />$7,500.00, which reimbursement shall be charged to the Sewer and Wastewater <br />Treatment Improvement Fund. <br /> <br /> Section 3. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this Ordinance were adopted <br />in an open meeting of this Council, and that all such deliberations of this <br />Council and of any of its committees that resulted in such formal action, were <br />in meetings open to the public, in compliance with all legal requirements includ- <br />ing Section 12i.22 of the Ohio Revised Code. <br /> <br /> Section 4. That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preambte hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest period <br />allowed by law. <br /> <br />Adopted: <br /> <br /> <br />
