ORDINANCE NO. 98-81 BY: Brown, Chinnock, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE to amend Section~73.)5(j) of the Traffic Code of the Codified Ordinances of the City of Lak~o~d, relating to the prohibition of operating motorized bicycles on areas intended for pedestrian travel. WHEREAS, there is within the City a number of designated areas which are intended for pedestrian travel but which do not fit the definition of side- walk, and WHEREAS, these lanes which include but are not limited to Rose Lane, Chase Lane, Arlington Lane, Edwards Lane, and Shaw Lane, and WHEREAS, the operation of motorized bicycles on these lanes is a potential danger and risk to both riders and pedestrians, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety, and welfare, and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 3~5~.~5(j) of the Traffic Code of the Codified Ordinances of the City of Lakewood, 5~ reading as follows: 373.15 RIDING REGULATIONS. It shall be legal to ride a bicycle upon a sidewalk, street or public way, or upon any path set aside for the exclusive use of bicycles, subject to the following: (j) No person shall operate a motorized bicycle upon any public sidewalk. shall be and the same is hereby amended to read as follows: 373.15 RIDING REGULATIONS It shall be legal to ride a bicycle upon a sidewalk, street or public way, or upon any path set aside for the exclusive use of bicycles, subject to the following: (j) No person shall operate a motorized bicycle upon any public sidewalk, lane, or walkway intended for pedestrian travel. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted tn an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in comp~liance with all legal requirements, includ- ing Section t21.22 of the Ohio Revised Code. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thrids of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law, and existing Section 373.15(j) of the Traffic Code of the Codified Ordinances of the City of Lakewood, is hereby repealed at such time.
