ORDINANCE NO. 98-81 <br /> <br />BY: Brown, Chinnock, Graham, McBride, <br /> Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to amend Section~73.)5(j) of the Traffic <br />Code of the Codified Ordinances of the City of Lak~o~d, relating to the <br />prohibition of operating motorized bicycles on areas intended for pedestrian <br />travel. <br /> <br /> WHEREAS, there is within the City a number of designated areas which <br />are intended for pedestrian travel but which do not fit the definition of side- <br />walk, and <br /> <br /> WHEREAS, these lanes which include but are not limited to Rose Lane, <br />Chase Lane, Arlington Lane, Edwards Lane, and Shaw Lane, and <br /> <br /> WHEREAS, the operation of motorized bicycles on these lanes is a <br />potential danger and risk to both riders and pedestrians, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety, and welfare, and <br />for the usual daily operation of a municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 3~5~.~5(j) of the Traffic Code of the Codified <br />Ordinances of the City of Lakewood, 5~ reading as follows: <br /> <br />373.15 RIDING REGULATIONS. <br /> <br />It shall be legal to ride a bicycle upon a sidewalk, street or <br />public way, or upon any path set aside for the exclusive use of <br />bicycles, subject to the following: <br /> <br />(j) No person shall operate a motorized bicycle upon any public <br />sidewalk. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />373.15 RIDING REGULATIONS <br /> <br />It shall be legal to ride a bicycle upon a sidewalk, street or <br />public way, or upon any path set aside for the exclusive use <br />of bicycles, subject to the following: <br /> <br />(j) No person shall operate a motorized bicycle upon any <br />public sidewalk, lane, or walkway intended for pedestrian <br />travel. <br /> <br /> Section 2. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted <br />tn an open meeting of this Council, and that all such deliberations of this <br />Council and of any of its committees that resulted in such formal action, were <br />in meetings open to the public, in comp~liance with all legal requirements, includ- <br />ing Section t21.22 of the Ohio Revised Code. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thrids of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest period <br />allowed by law, and existing Section 373.15(j) of the Traffic Code of the Codified <br />Ordinances of the City of Lakewood, is hereby repealed at such time. <br /> <br />Adopted: <br /> <br /> <br />
