ORDINANCE NO. 99-81 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ordinance to amend Section 352,04 and enact new Section <br />355.13 of the Traffic Code of the Codified Ordi~nances of the City of Lakewood <br />to permit motor vehicles bearing license plates issued pursuant to Ohio Revised <br />Code 4503.41 [Disabled Veterans) and Ohio Revised Code Section 4503.46 (Former <br />Prisoner of War) to be parked in parking meter spaces both off-street and on- <br />street, without charge. <br /> <br /> WHEREAS, pursuant to the provisions of the Ohio Revised Code, <br />certain disabled veterans and former prisoners of war are permitted free <br />motor vehicle registration and are issued special license plates indi- <br />cating such disability and status, and <br /> <br /> WHEREAS, this Council as an expression of its appreciation and re- <br />cognition of the service rendered by these veterans to this country, desires <br />to permit the motor vehicles of disabled veterans whose disabilities are rated <br />at 100 percent.by the Veterans' Administration and prisoners of war to be <br />parked in both off-street and on-street parking meter spaces without charge. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety, and welfare, and <br />for the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 353.04 of the Traffic Code of the Codified <br />Ordinances of the City of Lakewood, now reading as follows: <br /> <br />353.04 APPLICATION OF PARKING METER PROVISIONS. <br /> <br />The provisions of Sections 355.02, 355.04, 355.06, 355.07, <br />355.08, 355.10 and 355.11 shall be applicable to off-street <br />parking areas. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />353.04 APPLICATION OF PARKING METER PROVISIONS <br /> <br />The provisions of Sections 355.02, 355.04, 355.06, 355.07 <br />355.08, 355,10, 355.11 and 355.13 shall be applicable to <br />off-street parking areas. <br /> <br /> Section 2, That new Section 355.13 of the Traffic Code of the Codi- <br />fied Ordinances of the City of Lakewood shall be and the same is hereby enact,- <br />ed to read as follows: <br /> <br />355.13 EXCEPTIONS <br /> <br />Motor vehicles bearing license plates issued pursuant to Ohio <br />Revised Code Section 4503,41(Plates red, white and blue in color <br />and ii~scdbed with the word "Veteran" and imprinted with the <br />international wheelchair symbol)and motor vehicles bearing <br />license plates issued pursuant to Ohio Revised Code Section <br />4503.46 (inscribed with the words "FORMER POW") shall be ~er- <br />mitred to be parked in parking meter spaces without charge, <br />while operated by or for the transport of such veterans. <br /> <br /> Section 3, It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted <br />in an open meeting of this Council, and that all such deliberations of this <br />Council and of any o~ its committees that resulted in such formal action, were <br />in meetings open to the public, in compliance with all legal requirements includ- <br />ing Section 121,22 of the OhiQ Revised Code. <br /> <br /> <br />
