<br />'. <br /> <br />EASEMENT AGREEMENT <br /> <br />For Driveway from Metropolitan Park Drive <br />to Lakewood Wastewater Treatment Plant <br /> <br />This Agreement made this day of , <br />1981 between the Board of Park Commissioners of the Cleveland Metropolitan <br />Park District ("Metroparks") and the City of Lakewood ("Lakewood") <br /> <br />That <br /> <br />park lands in the City of <br />and which are adjacent to <br /> <br />T N E SSE T H: <br /> <br />WHEREAS, Metroparks is the owner of <br />Rocky River upon which is located Park Drive <br />the Lakewood wastewater treatment plant; and <br /> <br />I <br /> <br />W <br /> <br />íVHEREAS, Lakewood desires to continue to use, maintain and <br />improve an existing driveway across Metroparks property connecting <br />the Park Drive with the site of said plant. <br /> <br />NOW, THEREFORE, in consideration of the sum of One Dollar ($1.00) <br />receipt of which is hereby acknowledged, and for other good and valuable <br />considerations set forth herein, it is agreed as follows: <br /> <br />1. Metroparks hereby grants to Lakewood, and to its successors <br />and assigns, upon the terms and conditions hereinafter set forth, the <br />right, license, and privilege to continue to use, maintain, and improve <br />an existing driveway, approximately 12' (twelve feet) wide, through the <br />following described strip or parcel of land situated in the City of <br />Rocky River, Cuyahoga County, Ohio, and being more particularly bounded <br />and described as follows: <br /> <br />Situated in the City of Rocky River, County <br />of Cuyahoga, State of Ohio, and known as <br />being in the Minor Mill Lot Survey of <br />Cuyahoga County Records, and also known as <br />being part of original Rockport Township <br />Section Number 18 and together bounded <br />and described as follows: <br /> <br />Beginning at a Stone Monument which is the <br />center line of Riverside Drive (60'Wide) <br />and the center line of Madison Avenue <br />(80'Wide) in the City of Lakewood. Thence <br />due west a distance of 997.47 feet to a <br />point which is the principal place of <br />beginning of the center line of the 30 <br />(thirty foot) drive eaSement. <br /> <br />Thence, south 40 0' 00" east a distance of <br />432.5 feet to a point which is the northerly <br />line of Metropolitan Park Drive. The ease- <br />ment shall extend 15' (fifteen feet) along <br />each side of said center line <br /> <br />but subject to all <br /> <br />Be the same more or less <br />legal highways <br /> <br />keep open and free of <br /> <br />, <br /> <br />2.
