ORDINANCE NO. 27-82 BY: Brown, Chinnock, Graham, Salmon, Wendling AN EMERGENCY ORDINANCE to amend paragraph (b) of Section 135.07 of the Administrative Code of the Codified Ordinances of the City of Lakewood relating to fees for polygraph tests. WHEREAS, the cost to conduct polygraph examinations has increased to the extent that current fees are insufficient to cover such costs, and WHEREAS, this Council deems it to be in the best interest of the City that polygraph fees be increased from their present rate, and WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That paragraph (b) of Section 135.07 of the Administrative Code of the Codified Ordinances of the City of Lakewood, now reading as follows: 135.07 POLYGRAPH TESTS; FEES. (b) In order to defray the cost of the polygraph examination, the Chief of Police is authorized and directed to charge a fee of fifty dollars ($50.00) for each polygraph examination given for the investigation of crime, and a fee of forth dollars ($40.00) for each polygraph examination given to determine qualifications for employment in police departments. Such fees collected shall be paid by the Chief of Police to the Director of Finance, who shall credit them to the General Fund of the City. be and the same is hereby amended to read as follows: 135.07 POLYGRAPH TESTS; FEES. (b) In order to defray the cost of the polygraph examination, the Chief of Police is authorized and directed to charge a fee of ninety dollars ($90.00) for each polygraph examination given for the investigation of crime, and a fee of fifty-five dollars ($55.00) for each polygraph examination given to determine qualifications for employment in police departments. Such fees collected shall be paid by the Chief of Police to the Director of Finance, who shall credit them to the General Fund of the City. Section 2, It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting cf this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 3. This this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds cf all members elected to Council, it shall take effect and be in force immediat~!y upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law and existing paragrpah (b) of Section 135.07 of the Administrative Code adopted December 4, 1978, shall be and the same is hereby repealed at such time.
