ORDINANCE NO. 27-82 <br /> <br />BY: Brown, Chinnock, Graham, <br /> Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to amend paragraph (b) of Section 135.07 of <br />the Administrative Code of the Codified Ordinances of the City of Lakewood <br />relating to fees for polygraph tests. <br /> <br /> WHEREAS, the cost to conduct polygraph examinations has increased to <br />the extent that current fees are insufficient to cover such costs, and <br /> <br /> WHEREAS, this Council deems it to be in the best interest of the City <br />that polygraph fees be increased from their present rate, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That paragraph (b) of Section 135.07 of the Administrative <br />Code of the Codified Ordinances of the City of Lakewood, now reading as follows: <br /> <br />135.07 POLYGRAPH TESTS; FEES. <br /> <br />(b) In order to defray the cost of the polygraph examination, <br />the Chief of Police is authorized and directed to charge a fee <br />of fifty dollars ($50.00) for each polygraph examination given <br />for the investigation of crime, and a fee of forth dollars <br />($40.00) for each polygraph examination given to determine <br />qualifications for employment in police departments. Such fees <br />collected shall be paid by the Chief of Police to the Director <br />of Finance, who shall credit them to the General Fund of the <br />City. <br /> <br />be and the same is hereby amended to read as follows: <br /> <br />135.07 POLYGRAPH TESTS; FEES. <br /> <br />(b) In order to defray the cost of the polygraph examination, <br />the Chief of Police is authorized and directed to charge a fee <br />of ninety dollars ($90.00) for each polygraph examination given <br />for the investigation of crime, and a fee of fifty-five dollars <br />($55.00) for each polygraph examination given to determine <br />qualifications for employment in police departments. Such <br />fees collected shall be paid by the Chief of Police to the <br />Director of Finance, who shall credit them to the General <br />Fund of the City. <br /> <br /> Section 2, It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting cf this Council, and that all such deliberations of <br />this Council and of any of its committees that resulted in such formal action, <br />were in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 3. This this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds cf all members elected to Council, it shall <br />take effect and be in force immediat~!y upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest <br />period allowed by law and existing paragrpah (b) of Section 135.07 of the <br />Administrative Code adopted December 4, 1978, shall be and the same is hereby <br />repealed at such time. <br /> <br /> <br />
