ORDINANCE NO. 50-82 BY: Brown, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE authorizing the Mayor to enter into an agreement with the Board of Education of the Lakewood City School District for the control, maintenance, and operation of the Harrison Neighborhood Facility. WHEREAS, the Lakewood Board of Education conducts the general recrea- tion program throughout the City of Lakewood, and is property equipped to operate, control and maintain said facility, and WHEREAS, Section 755.16 of the Ohio Revised Code gives authority to a municipal corporation to operate and maintain recreational facilities jointly with a school district, and WHEREAS, this Council determines it to be in the best interest of the City that at such time as the Harrison Neighborhood Facility is completed and ready for operation, the City enter into an agreement with the Board of Education for the joint operation of said facility, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor is hereby authorized and directed to enter into an agreement with the Board of Education of the Lakewood City School District for the control, maintenance, and operation of the Harrison Neighbor- hood Facility, said agreement to be substantially in the form as set forth in Exhibit "A" attached hereto and made a part hereof as if fully rewritten herein. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 3. That this Ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest Adopted: peri od allowed by law.
