ORDINANCE NO. 50-82 <br /> <br />BY: Brown, Gallagher, Graham, McBride, <br /> Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor to enter into an agreement <br />with the Board of Education of the Lakewood City School District for the control, <br />maintenance, and operation of the Harrison Neighborhood Facility. <br /> <br /> WHEREAS, the Lakewood Board of Education conducts the general recrea- <br />tion program throughout the City of Lakewood, and is property equipped to <br />operate, control and maintain said facility, and <br /> <br /> WHEREAS, Section 755.16 of the Ohio Revised Code gives authority to a <br />municipal corporation to operate and maintain recreational facilities jointly <br />with a school district, and <br /> <br /> WHEREAS, this Council determines it to be in the best interest of the <br />City that at such time as the Harrison Neighborhood Facility is completed and <br />ready for operation, the City enter into an agreement with the Board of <br />Education for the joint operation of said facility, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, and welfare and for the <br />usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor is hereby authorized and directed to enter <br />into an agreement with the Board of Education of the Lakewood City School <br />District for the control, maintenance, and operation of the Harrison Neighbor- <br />hood Facility, said agreement to be substantially in the form as set forth in <br />Exhibit "A" attached hereto and made a part hereof as if fully rewritten herein. <br /> <br /> Section 2. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this Ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations of <br />this Council and of any of its committees that resulted in such formal action, <br />were in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 3. That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest <br /> <br />Adopted: <br /> <br />peri od allowed by law. <br /> <br />C~RK' <br /> <br />Approved: <br /> <br /> <br />
