54-82 Amend 903.03 Streets - sidewalk width

ORDINANCE NO.: 54-82 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE to amend Section 903.03 of the Streets, Utilities, & Public Services Code of the City of Lakewood. WHEREAS, the sidewalk on Clifton Boulevard are in a very bad condition due in a large part to damage caused by roots of trees along the sidewalks, and, WHEREAS, it would be in the best interest of the City to reduce the required width of .sidewalks on Clifton Blvd. from six feet to five feet to allow for growth of trees close to the existing sidewalks which are causing the damage, and, WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public safety, and welfare and for the usual daily operation of a municipal department; now, therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 903.03 of the Streets, Util%ties Public Services Code of the Codified Ordinances of the City of Lakewood now reading as follows: 903.03 SIDEWALK WIDTHS On all streets and alleys of not less than thirty- three or more than forty feet in width, the sidewalks shall be not less than four feet wide. On all streets not less than forty nor more than sixty feet in width, all sidewalks shall be not less than five feet wide. On all streets more than sixty feet wide and on all main streets or east and west thoroughfares, all side- walks shall be not less than six feet wide. However, on any street which is not a main street or an east and west thoroughfare, but is nevertheless devoted entirely to residences, the sidewalks shall be not less than five feet wide. shall be and the same is hereby amended to read as follows: 903.03 SIDEWALK WIDTHS On all streets and alleys of not less than thirty- three or more than forty feet in width, the sidewalks shall be not less than four feet wide. On Clifton Boulevard, all sidewalks shall be not less than five feet wide. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this Ordin- ance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
