ORDINANCE NO. 85-82 BY: Brown, Chinnock, Graham, Salmon, Wendling AN EMERGENCY ORDINANCE authorizing and directSng the Mayor to purchase certain real property located at 1467 Belle Avenue hereinafter more particularly described. WHEREAS, the Hospital Board of Trustees five-year plan included a recommendation that suitable property in the Hospital vicinity be acquired as it becomes available for future requirements of the Hospital's present programs and facilities, and WHEREAS, the Hospital Administration has established a property acquisi- tion policy which requires consultation with the Mayor, Chairman of the Hospital Board of Trustees' Finance Committee and the Chairman of the City Council Hospital Committee prior to an offer being made by the Hospital to the property owner, and WHEREAS, an approved offer was made to the property owners and said propertyowners have accepted same, and WHEREAS, the Board of Trustees of Lakewood Hospital by Resolution 690 adopted September 10, 1982 requested Council adopt appropriate legislation authorizing the acquisition of the subject property for future Hospital expansion, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public safety and welfare and for the usual daily operation of a municipal department and for the further reason that the owners have agreed to sell said property for the consideration herein stipulated and this Council determines it to be in the best interest of the City that the property be purchased as soon as possible. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor be and he is hereby authorized and directed to purchase from Michael Bracken and Linda Bracken the following described property: "And being known as Sublot No. 121 in Belle Avenue Allotment of part of Original Rockport Township, Section 22 as shown by the recorded plat of said allotment, Volume 41 of Maps, page 23 of Cuyahoga County records. Said Sublot No. 121 has a frontage of 45.00 feet on the easterly side of Belle Avenue and extends back 187.72 feet on the northerly line, 187.62 feet on the southerly line and has a rear line of 45.00 feet as appears by said plat, be the same more or less, but subject to all legal highways." and to pay therefor the sum of Sixty-Four Thousand Dollars ($64,000.00). Section 2. That the title to said property shall be subject to the approval of the Director of Law; that taxes and assessments shall be pro- rated as of the date of the filing of the Deed for record using the last available tax rate and valuation for computing tax prorations; that the Direc- tor of Finance be and he is hereby authorized to pay the amount set forth in
