Please substitute for Ordinance <br />No. 22-83 placed on first reading <br />March 21, 1983 and referred to the <br />Planning and Zoning Committee of <br />Council and the Planning Commission <br />and placed on second reading April <br />4, 1983. <br /> <br />ORDINANCE NO. 22-83 <br /> <br />BY: Brown, CHinnock, Gal!agher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN ORDINANCE to supplement Section 1113.04 of the Zoning Code <br />of the Codified Ordinances of the City of Lakewood to provide for the con- <br />struction of Assisted-Living Housing as a Special Exception in Business <br />Residential (BR) Districts. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 1113.04 of the Zoning Code of the Codified <br />Ordinances of the City of Lakewood shall be and the same is hereby supple- <br />mented by enacting new subparagraph (b)(5~ to read as follows: <br /> <br />1113.04 SPECIAL EXCEPTIONS: <br /> <br />The following uses if approved by the Board of Zoning Code Appeals <br />after public notice and public hearing may be permitted as a <br />Special Exception when the standards and conditions specified <br />for each uss are complied with. <br /> <br />(a) <br /> <br />(b) In granting of a Special Exception, the Board of Zoning <br />Appeals may prescribe such additional conditions and safeguards <br />as it deems necessary, desirable, or appropriate. The Board <br />may vary the standards specified for land area and minimum di- <br />mensions for an exception when it finds, (1) it is unreasonable <br />for the applicant to acquire more land, (2) the land is suit- <br />able for the proposed use, (3) the proposed use will not be <br />detrimental to the neighborhood, (4) any educational facilities <br />shall be on the same parcel as the church building and full time <br />classes shall meet state educational standards. <br /> <br />(1) <br />(2) <br />(3) <br />(4) <br />(5) <br /> <br />ASSISTED-LIVING HOUSING: <br /> <br />Assisted-living facilities which provide living accommodations <br />for persons who do not require nursing home care but need <br />assistance in maintaining a dwelling unit and which also <br />provides at least one meal per day in the cost of such <br />housing shall be permitted provided the following conditions <br />are met: <br /> <br />(a) The minimum lot width at the building line shall be <br /> forty feet. <br />(b) There shall be a minimum of three hundred (300) square <br /> feet of lot area for each unit. <br />(c) The maximum percent of a lot that may be occupied by <br /> a building shall be thirty (30) percent. <br />(d) The required number of off-street parking spaces <br /> shall be not less than forty (40) percent of the <br /> total number of dwelling units. <br /> <br /> <br />
