ORDINANCE NO: 58-83 <br /> <br />BY: Brown, Chinnock, Gallagher <br /> Graham, McBride, Salmon, <br /> Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing the City Engineer to advertise for bids <br />and enter into a contract with the lowest and best bidder after advertisement accord- <br />ing to law for the improvement of certain streets in the City of Lakewood by removal, <br />where necessary, of the existing surface course, by grading and replacement where <br />necessary, of the base and by resurfacing with asphaltic concrete including the <br />necessary replacement and resetting of castings together with necessary appurtenances <br />hereto. <br /> <br /> WHEREAS, Council has determined that the pavement on certain streets are <br />badly deteriorated and in urgent need of replacement and that the improvements here- <br />in provided are immediately necessary to eliminate existing hazards to vehicular <br />traffic using the streets of this City, and <br /> <br /> WHEREAS, this Council has authorized the preparation of construction draw- <br />ings and specifications by the Lakewood Engineering Department, and <br /> <br /> WHEREAS, the aforementioned construction drawings and specifications are <br />now on file in the City Engineer's office, ~nd <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for <br />the usual daily operation of a municipal department and for the immediate preser- <br />Vation of the public safety and welfare; now, therefore <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the City Engineer be and he is hereby authorized and <br />directed to advertise for bids and enter into a contract with the lowest and best <br />bidder after advertisement according to law to improve the following streets in <br />the City of Lakewood: <br /> <br />1. Morrison Avenue (Madison to Delaware); <br />2. Marlowe Avenue (Franklin to Madison); <br />3. Clarence Avenue (Detroit to Hazelwood); <br />4. Elmwood Avenue (Detroit to Madison); and <br />5. Lakeland Avenue (Detroit to Clifton. <br /> <br /> Section 2. That the cost of such construction is estimated at $311,230 which <br />funds are to be made available from the Community Development Block Grant Funds. <br /> <br /> Section 3. That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, it shall take <br />effect and be in force immediately upon its adoption and approval by the Mayor; <br />otherwise it shall take effect and be in force after the earliest period allowed <br />by law. <br /> <br /> President <br /> <br />Approved:~ <br /> <br /> <br />
