ORDINANCE NO. 62-83 BY: Brown, CHinnock, Gallagher, Graham, Salmon, Wendling AN EMERGENCY ORDINANCE authorizing and directing the Mayor to purchase certain real property located at 1483 Belle Avenue, hereinafter more parti- cularly described. WHEREAS, the Hospital Board of Trustees five-year plan included a recommendation that suitable property in the Hospital vicinity be acquired as it becomes available for future requirements of the Hospital's present programs and facilities, and WHEREAS, the Hospital Administration has established a property acqui- sition policy which requires consultation with the Mayor, Chairman of the Hospital Board of Trustees' Finance Committee and the Chairman of the City Council Hospita~ Committee prior to an offer being made by the Hospital to the property owner, and WHEREAS, an approved offer was made to the property owner and said property owner has accepted same, and WHEREAS, the Board of Trustees of Lakewood Hospital by Resolution 759, adopted April 26, 1983 requested Council adopt appropriate legislation authorizing the acquisition of the subject property for future Hospital expansion, and WHEREAS, this Ordinance constitutes an emergency measure providing for the immediate preservation of the public safety and welfare and for the usual daily operation of a municipal department and for the further reason that the owners have agreed to sell said property for the consideration herein stipulated and this Council determines it to be in the best interest of the City that the property be purchased as soon as possible, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor be and he is hereby authorized and directed to purchase from June Post Manning the following described property: Situated in the City of Lakewood, County of Cuyahoga, and State of Ohio, and known as Sublot 118 in Belle Avenue Allotment of Part of Original Rockport Township No. 22, as shown by the recorded plat in Volume 41 of Maps, Page 23 of Cuyahoga County Records, and being 45 feet front on the Easterly side of Belle Avenue, 187.41 feet deep on the Northerly line, 187.31 feet deep on the Southerly line and 45 feet wide in the rear, as appears by said plat, be the same more or less, but subject to all legal highways. Being the same undivided one-half interest acquired by the grantor herein by Deed dated November 6, 1956, and recorded in Deed Book 8806, page 268 of the Deed Records of Cuyahoga County, Ohio. and to pay therefor the sum of Seventy-Two Thousand Dollars ($72,000). Section 2. That the title to said property shall be subject to the approval of the Director of Law; that taxes and assessments shall be pro- rated as of the date of the filing of the Deed for record using the last available tax rate and valuation for computing tax prorations; that the Director of Finance be and he is hereby authorized to pay the amount set
