ORDINANCE NO. 81-83 BY: Brown, Ch'innock, Gallagher, Graham, McBride, Salmon, Wendling AN ORDINANCE to amend Section 1101.35 of the Zoning Code of the Codi- fined Ordinances of the City of Lakewood to exempt poles for the exclusive dis- play of the American flag from the restrictions imposed through definition of "yard." WHEREAS, this Council determines it to be desirable to encourage the display of theAmerican flag, and WHEREAS, such display by means of a pole erected in front of the bui!d,-, ing line requires an appearance and approval by the Board of Zoning Appeals which this Council feels discourages the erection of poles for the display of the American flag, now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 1101.35 of the Zoning Code of the Codified Ordinances of the City of Lakewood, now reading as follows: 1101.35 YARD. "Yard" means an o~en space on a lot, unoccupied and unob- structed from the ground to the sky. Roof overhang of 12 inches including rain gutters shall be exempt. shall be and the same is hereby amended to read as follows: 1101.35 YARD "Yard" means an open space on a lot, unoccupied and unob- structed from the ground to the sky. Roof overhang of 12 inches including rain gutters and a pole for the exclusive display of the American flag shall be exempt. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
