ORDINANCE NO. 90-83 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to supplement Chapter 741 of the Business Regu- <br />lation Code of the Codified Ordinances of the City of Lakewood by enacting new <br />Section 741.071 to prohibit the display for sale of household goods and furnish- <br />ings from front yards and front porches of non-retail occupancies. <br /> <br /> WHEREAS, the public display of household goods and furnishings from <br />front porches and front yards by the residents thereof offering same for sale <br />create unsightly conditions throughout the residential areas of the City, and <br /> <br /> WHEREAS, in order to eliminate such a detrimental effect upon the <br />aesthetic beauty of the City, this Council determines that the display of <br />merchandise for sale by residents from their home should be confined to the <br />rear yard area of the premises, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health and welfare; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Chapter 741 of the Business Regulation Code of the <br />Codified Ordinances of the City of Lakewood shall be and the same is hereby sup- <br />plemented by enacting new Section 741.071 to read as follows: <br /> <br />741.071 DISPLAY FOR SALE OF HOUSEHOLD GOODS AND FURNISHINGS <br /> FROM NON-RETAIL OCCUPANCIES. <br /> <br />No person shall display for sale, any household goods, furnishings <br />or personal effects, including clothing, in any area of non-retail <br />occupied premises upon which said goods are displayed other than <br />from the rear yard as defined in Section 1101.37 of the Zoning Code <br />and/or the garage, if any, situated thereon. <br /> <br /> Section 2. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations of <br />this Council and of any of its committees that resulted in such formal action, <br />were in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br /> <br />Mayor; otherwise, it shall take effect and be in force after the earliest <br />period allowed by law. <br /> <br />Approved~~ <br /> <br /> <br />
