ORDINANCE NO: 113-84 <br /> <br />BY: Brown, Chinnock, GallagheF <br /> Graham, McBride, Salmon, <br /> Wendl i ng <br /> <br /> AN EMERGENCY ORDINANCE to amend paragraph (b) of Section 913.06 <br />and enact new paragraph (c) to Section 913.09 of the Streets and Public <br />Services Code of the Codified Ordinances of the City of Lakewood, re- <br />lating to regulations of the use of municipal and private sewers and <br />drains and the discharge of waters and wastes into the public sewer <br />system. <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure <br />providing for the usual daily operation of a municipal department; now, <br />therefore; <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO: <br /> <br /> Section 1. That Section 193.06 of the Streets and Public <br />Services Code of the Codified Ordinances of the City of Lakewood now <br />reading as follows: <br /> <br />913.06 USE OF ~CONICIPAL SEWERS <br /> <br />(b) Storm water and all other ~m%polluted drainage shall <br /> be discharged to such sewers as are specifically <br /> designated as storm sewers, or to a natural outlet <br /> approved by the City Engineer. Industrial cooling <br /> water or unpolluted process waters shall be dis- <br /> charged, on approval of the City Engineer to a <br /> storm sewer or natural outlet. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />913.06 USE OF HUNICIPAL SE~RS <br /> <br /> (a) ........ <br /> (b) Storm water and all other %mpolluted drainage shall <br /> .be discharged to such sewers as are specifically <br /> designated as storm sewers or to a natural outlet <br /> approved by the City Engineer or by means of over- <br /> land flow provided a nuisance to adjacent property <br /> does not occur and it is approved by the City <br /> Engineer. Industrial cooling water or unpolluted <br /> process waters shall be discharged, on approval of <br /> the City Engineer to a storm sewer or natural out- <br /> let. <br /> <br /> Section 2. That Section 913.09 of the Streets and Public Ser- <br />vices Code of the Codified Ordinances of the City of Lakewood is hereby <br />supplemented by enacting new paragraph (c) thereof to read as follows: <br /> <br />913.09 LIABILITY <br /> <br />(b) ............ <br /> <br />(c) Each user or owner shall indemnify the Municipality <br /> from any loss or damage that may directly or indi- <br /> rectly be occasioned by the discharge of stormwater <br /> overland or to a natural outlet as approved by the <br /> City Engineer, <br /> <br /> <br />
