ORDINANCE NO. 57-84 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE to amend Paragraph (c) of Section 905.15 of the Streets and Public Services Code of the Codified Ordinances of the City of Lakewood relating to permits for picnics at Lakewood Park. WHEREAS, on February 21, 1984, this Council amended Section 905.15 of the Streets and Public Services Code which in part provides that use of the Ki- wanis Pavilion and Shelter House Pavilion in Lakewood Park is limited to City based-organizations or organizations whose membership is fifty percent or more Lakewood residents, and WHEREAS, it has come to the attention of Council that this limitation has caused a hardship to a number oF non-qualifying groups which have come to rely upon the use of the facilities at Lakewood Park over the years, and WHEREAS, this Council determines that, in the interest of fairness, non-qualifying groups who have used the picnic facilities of Lakewood Park in the past should be permitted to continue such use, at least during mid-week rather than on weekends when the facilities are most in demand, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public welfare and for the usual ~laily operation ofoa municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Paragraph (c) of Section 905.15 of the Streets and Public Services Code of the Codified Ordinances of the City of Lakewood, now reading as follows: 905.15 PICNIC AREAS; PERMIT FOR USE OF PICNIC PAVILIONS. (b) (c) ~o' ~ermit shall be issued to any individual represent- ing a business organization, civic organization, club or association, but excluding a family picnic gathering, un- less such organization, etc. is based within the City of Lakewood or its membership is comprised of not less than fifty percent (50%) Lakewood residents. shall be and the same is hereby amended to read as follows: 905.15 PICNIC AREAS; PERMIT FOR USE OF PICNIC PAVILIONS. (a) . (b) (C) ~0' ~ermit shall be issued to any individual represent- ing a business organization, civic organization, club or association, but excluding a family picnic gathering, un- less such organization, etc. is based within the City of Lakewood or its membership if comprised of not less than fifty percent (50%) Lakewood residents; provided, however, for the 1984 season a permit may be issued to a non-qualify- ing organization for weekday use only if such organization has previously been issued a picnic permit for two out of the prior three seasons, and for the 1985 season and there- after a permit may be issued to a non-qualifying organiza- tion for weekday use only if such organization had been is- sued a permit for the immediately preceeding year. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open. to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
