Placed on First Reading March 4, 1985 Placed on Second Reading March 18, 1985 ORDINANCE NO. 11-85 BY: Brown, Chinnock, Gallagher, Graham, McBride, Wendling AN ORDINANCE to repeal paragraph (1)(d) of Section 1113.04 of the Zoning Code relating to terms and conditions permitting gasoline service stations as a special exception in a Business Residential (BR) District. WHEREAS, the current height limitation for pumps and racks of gasoline service stations is outdated, too restrictive, and prohibitive, and WHEREAS, the current gasoline service station conditions relating to the location and construction of service islands were established prior to the establishment of the Architectural Board of Review, and would be more appropriate- ly addressed by that Board; now; therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That paragraph (1)(d) of Section 1113.04 of the Zoning Code of the Codified Ordinances of the City of Lakewood relating to the terms and conditions permitting gasoline service stations as a special exception in a BR District, now reading as follows: 1113.04 SPECIAL EXCEPTION (a) (b) (ii(;)' . . . (b) . (c) . . (d) One or more concrete service islands may be constructed or installed in front of the building line but not nearer than fifteen (15) feet to any street line, which islands shall be raised not lesS than four (4) inches nor more than twelve (12) inches above grade and upon which may be installed one or more gasoline pumps, and one or more oil racks for the storage and dispensing of oil from cans of approximately one quart capacity, no such pump or rack to exceed six (6) feet in height above grade. shall be and the same is hereby repealed. Section 2. That subparagraphs (e), (f), (g), (h), (i), (j), and (k) of said paragraph (1) of Section 1113.04 of the Zoning Code be relettered (d), (e), (f), (g), (h), (i), and (j), respectively. ~ Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
