Placed on First Reading March 4, 1985 <br />Placed on Second Reading March 18, 1985 <br /> <br />ORDINANCE NO. 11-85 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Wendling <br /> <br /> AN ORDINANCE to repeal paragraph (1)(d) of Section 1113.04 of the <br />Zoning Code relating to terms and conditions permitting gasoline service stations <br />as a special exception in a Business Residential (BR) District. <br /> <br /> WHEREAS, the current height limitation for pumps and racks of gasoline <br />service stations is outdated, too restrictive, and prohibitive, and <br /> <br /> WHEREAS, the current gasoline service station conditions relating to <br />the location and construction of service islands were established prior to the <br />establishment of the Architectural Board of Review, and would be more appropriate- <br />ly addressed by that Board; now; therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That paragraph (1)(d) of Section 1113.04 of the Zoning <br />Code of the Codified Ordinances of the City of Lakewood relating to the terms <br />and conditions permitting gasoline service stations as a special exception in a <br />BR District, now reading as follows: <br /> <br />1113.04 SPECIAL EXCEPTION <br /> <br />(a) <br />(b) <br /> <br /> (ii(;)' . . . <br /> (b) . <br /> (c) . . <br /> (d) One or more concrete service islands may be <br />constructed or installed in front of the building line but <br />not nearer than fifteen (15) feet to any street line, which <br />islands shall be raised not lesS than four (4) inches nor <br />more than twelve (12) inches above grade and upon which may <br />be installed one or more gasoline pumps, and one or more oil <br />racks for the storage and dispensing of oil from cans of <br />approximately one quart capacity, no such pump or rack to <br />exceed six (6) feet in height above grade. <br /> <br />shall be and the same is hereby repealed. <br /> <br /> Section 2. That subparagraphs (e), (f), (g), (h), (i), (j), and (k) <br />of said paragraph (1) of Section 1113.04 of the Zoning Code be relettered (d), <br />(e), (f), (g), (h), (i), and (j), respectively. ~ <br /> <br /> Section 3. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action, were in <br />meetings open to the public, in compliance with all legal requirements including <br />Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 4.
