<br />Ordinan, \placed on First Reading 4-15-85 <br />Ord;'nance placed on Second Reading 5-6-85 <br /> <br />ORDINANCE NO: 22-85 <br /> <br />BY: Brown, Chinnock, Gall agher, <br />Graham, Salmon, Wendling <br /> <br />AN EMERGENCY ORDINANCE to supplement the Generel <br />Offenses Code of the Codified Ordinances of the City of Lakewood <br />by enacting new Chapter 505 relating to Animals and Fowl and <br />repealing existing Chapter 505 of said Code. <br /> <br />WHEREAS, this Council determines it to be in the best <br />interests of the City to update the City's ordinances relating to <br />Animals and Fowl and codify same as a new Chapter 505 of the <br />General Offenses Code of the Codified Ordinances of the City of <br />Lakewood, and <br /> <br />WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, <br />safety and welfare and for the usual daily operation ofa <br />municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br />Section 1. That the General Offenses Code of the <br />Codified Ordinances of the City of Lakewood shall be and the same <br />is herepy supplemented by enacting new Chapter 505 of said Code <br />to read as follows: <br /> <br />CHAPTER 505 <br />Animals and Fowl <br /> <br />505·01 ANIMAL WARDEN <br /> <br />(a) The Animal Warden shall hold the posi- <br />tion as established by ordinance and shall be <br />appointed by the Director of Public Safety. <br />The Animal Warden shall not be on the classi- <br />fied list of the Division of Police, nor <br />eligible for participation in the Police Pen- <br />sion Fund. <br /> <br />(b) It shall be the duty of the Animal <br />Warden, and he shall have the authority, to <br />enforce the provisions of the Codified Ordi- <br />nances of the City. and laws of the State of <br />Ohio relative to the licensing, impounding, <br />boarding and disposition of animals, livestock <br />or poultry within the corporate limits; how- <br />ever no police or other officer of this City, <br />charged with the responsi bil1 ty of enforcing <br />the ordinances öf this City and the laws of <br />this State, shall be relieved of such respon- <br />sibility. <br /> <br />(c) The Animal Warden shaJJ, be provided with <br />a badge designating his office, and such <br />other uniform, vehicles and e~uipment <br />necessary to carry out his duties; however, <br />any vehicles used for picking up and im- <br />pounding animals, livestock or paul try shall <br />be clearly marked on both sides with thê fol- <br />lowing: IIAnimal Warden!!. <br /> <br />(d) In the exercise of his duties, the <br />Animal Warden is hereby authorized to issue, <br />on a form provided by the City, a citation to <br />
