ORDINANCE NO. 30-85 BY: Brown, Chinnock, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE authorizing the Mayor, for and on behalf of the City of Lakewood, to purchase an undivided one- half interest jointly with the Lakewood Historical Society, a non-profit corporation and to accept a deed from the 13401 Detroit Building Partnership, a partnership, for the property located at 13335 Detroit Avenue, Lakewood, Ohio, known as the Nicholson Homestead and to expend for said interest the sum of Thirty Five Thousand ($35,000) Dollars. WHEREAS, the James Nicholson house located 13335 Detroit Avenue in the City of Lakewood, was built in 1835 and is the oldest residence in the City, and WHEREAS, said Nicholson Homestead has been designated a historical landmark and it is in the best interest of the City to purchase said property from the 134~1 Detroit Building Partnership jointly with the Lakewood Historical Society so that said homestead may be restored and preserved for future community use, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health safety and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor be and he is hereby authorized and directed to purchase an undivided one-half interest jointly with the Lakewood Historical Society, a non- profit corporation, and to accept a deed from 13401 Detroit Building Partnership, a partnership, for the property located 13335 Detroit Avenue, Lakewood, Ohio, known as the Nicholson Homestead, and to pay for said interest the sum of Thirty Five Thousand ($35,000) Dollars. Section 2. That the cost of the aforementioned purchase in the amount of Thirty Five Thousand ($35,000) Dollars shall be appropriated from the Capital Improvement FUnd. Section 3. That the Mayor be and he is hereby authorized and directed to sign a mortgage deed in the amount of Fifteen Thousand ($15,000) Dollars in favor of the 13401 Detroit Building Partnership, a partnership, which mortgage deed shall be required to secure the debt of the Lakewood Historical Society Corporation in that amount. Section 4. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
