ORDINANCE NO. 30-85 <br /> <br />BY: Brown, Chinnock, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor, for and on <br />behalf of the City of Lakewood, to purchase an undivided one- <br />half interest jointly with the Lakewood Historical Society, a <br />non-profit corporation and to accept a deed from the 13401 <br />Detroit Building Partnership, a partnership, for the property <br />located at 13335 Detroit Avenue, Lakewood, Ohio, known as the <br />Nicholson Homestead and to expend for said interest the sum of <br />Thirty Five Thousand ($35,000) Dollars. <br /> <br /> WHEREAS, the James Nicholson house located 13335 Detroit <br />Avenue in the City of Lakewood, was built in 1835 and is the <br />oldest residence in the City, and <br /> <br /> WHEREAS, said Nicholson Homestead has been designated a <br />historical landmark and it is in the best interest of the City to <br />purchase said property from the 134~1 Detroit Building <br />Partnership jointly with the Lakewood Historical Society so that <br />said homestead may be restored and preserved for future community <br />use, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency <br />measure providing for the immediate preservation of the public <br />health safety and welfare and for the usual daily operation of a <br />municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby <br />authorized and directed to purchase an undivided one-half <br />interest jointly with the Lakewood Historical Society, a non- <br />profit corporation, and to accept a deed from 13401 Detroit <br />Building Partnership, a partnership, for the property located <br />13335 Detroit Avenue, Lakewood, Ohio, known as the Nicholson <br />Homestead, and to pay for said interest the sum of Thirty Five <br />Thousand ($35,000) Dollars. <br /> <br /> Section 2. That the cost of the aforementioned purchase <br />in the amount of Thirty Five Thousand ($35,000) Dollars shall be <br />appropriated from the Capital Improvement FUnd. <br /> <br /> Section 3. That the Mayor be and he is hereby <br />authorized and directed to sign a mortgage deed in the amount of <br />Fifteen Thousand ($15,000) Dollars in favor of the 13401 Detroit <br />Building Partnership, a partnership, which mortgage deed shall be <br />required to secure the debt of the Lakewood Historical Society <br />Corporation in that amount. <br /> <br /> Section 4. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of <br />this ordinance were adopted in an open meeting of this Council, <br />and that all such deliberations of this Council and of any of its <br />committees that resulted in such formal action, were in meetings <br />open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 5. That this ordinance is hereby declared to <br />be an emergency measure for the reasons stated in the preamble <br /> <br />1 <br /> <br /> <br />
