ORDINANCE NO. 31-85 <br /> <br />Brown, Chinnock, Gallagher, <br />Graham, ~cBride, Salmon, <br />Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the <br />Mayor for and on behalf of the City of Lakewood to enter into an <br />agreement with the Board of County Commissioners, County of <br />Cuyahoga, Ohio, to enable payment of services for legal represen- <br />tation of indigent persons charged with violation of a State <br />statute in the Lakewood Municipal Court. <br /> <br /> WHEREAS, the City of Lakewood recognizes its <br />responsiblity under the laws of the State of Ohio and of the <br />United States of America to provide legal counsel to indigent <br />persons charged with serious offenses and loss of liberty <br />offenses in its municipal court, and <br /> <br /> WHEREAS, the City of Lakewood, in furtherance of the <br />execution of its legal responsibilities, desires that the legal <br />services be delivered to the City's indigent citizens and others <br />so situated, and <br /> <br /> WHEREAS, the Board of County Commissioners, County of <br />Cuyahoga, Ohio, has advised the City that it will provide the <br />aforementioned legal services in an amount not to exceed Four <br />Thousand ($4,000) Dollars pursuant to a service contract, and it <br />is in the best interest of the City that it enter into such <br />agreement with the County, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, <br />safety and welfare; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCI OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby autho- <br />rized and directed, for and on behalf of the City of Lakewood to <br />enter into a service contract agreement with the Board of County <br />Commissioners, County of Cuyahoga, Ohio, to enable payment of <br />services for legal representation of indigent persons charged <br />with a violation of a State statute in the Lakewood Municipal <br />Court, said agreement to be substantially in the form as set <br />forth in Exhibit "A" attached hereto and made a part hereof. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of <br />this ordinance were adopted in an open meeting of this Council, <br />and that all such deliberations of this Council and of any of its <br />committees that resulted in such formal action, were in meetings <br />open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 3. That this ordinance is hereby declared to <br />be an emergency measure for the reasons stated in the preamble <br />hereof and provided it receives the affirmative vote of two- <br /> <br /> <br />
