ORDINANCE NO. 51-85 <br /> <br />BY: Brown, Chinnock, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to amend Section 1783.10 of the <br />Sanitary Code of the Codified Ordinances of the City of Lakewood <br />relating to the location of waste receptacles and to provide for <br />screening of same in certain zoning districts. <br /> <br /> WHEREAS, the uncontrolled placement of garbage and <br />refuse containers creates a blight in the immediate area and the <br />community as large, and <br /> <br /> WHEREAS, this Council determines that it is in the best <br />interest of the City that containers of garbage and refuse should <br />be in a controlled area and screened from general public view in <br />the M1, M2, BR, B1 and X zoning districts, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency <br />measure providing for the immediate preservation of the public <br />health, safety and welfare, and for the usual daily operation of <br />a municipal department; now, therefore, <br /> <br /> BE. IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF .OHIO: <br /> <br /> Section 1. That Section 1783.10 of the Codified <br />Ordinances of the City of Lakewood, now reading as follows: <br /> <br />1783.10 LOCATION OF RECEPTACLES. <br /> <br /> No person shall place or maintain any <br />receptacle for garbage, ashes or rubbish so <br />that it will be or constitute a nuisance. <br />Receptacles for garbage, ashes or rubbish <br />maintained for public collection shall not be <br />located within a building, shall not be higher <br />thatn the level of the first floor of the <br />building for which such receptacle is provided <br />and shall be so placed as to be readily <br />accessible for collection. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />1783.10 LOCATION OF RECEPTACLES. <br /> <br /> (a) No person shall place or maintain <br />any receptacle for garbage, ashes or rubbish <br />so that it will be or constitute a nuisance. <br /> <br /> (b) Receptacles for garbage, ashes or <br />rubbish maintained for public collection shall <br />be so placed as to be readily accessible for <br />collection. <br /> <br /> (c) In an M1, M2, BR, B1 and X zoning district, <br />no person shall store refuse or garbage lawfully retained <br />on the premises pending disposition thereof unless same is <br />stored out of view of the public right of way, within a <br />permanent building or structure or is shielded in a manner <br />approved by the Architectural Board of Review. <br /> <br /> (d) The Health Commissionerand the <br />Building Commissioner are hereby charged with <br />the enforcement of Paragraph (c) hereof. <br /> <br /> <br />
