ORDINANCE NO. 51-85 BY: Brown, Chinnock, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE to amend Section 1783.10 of the Sanitary Code of the Codified Ordinances of the City of Lakewood relating to the location of waste receptacles and to provide for screening of same in certain zoning districts. WHEREAS, the uncontrolled placement of garbage and refuse containers creates a blight in the immediate area and the community as large, and WHEREAS, this Council determines that it is in the best interest of the City that containers of garbage and refuse should be in a controlled area and screened from general public view in the M1, M2, BR, B1 and X zoning districts, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare, and for the usual daily operation of a municipal department; now, therefore, BE. IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF .OHIO: Section 1. That Section 1783.10 of the Codified Ordinances of the City of Lakewood, now reading as follows: 1783.10 LOCATION OF RECEPTACLES. No person shall place or maintain any receptacle for garbage, ashes or rubbish so that it will be or constitute a nuisance. Receptacles for garbage, ashes or rubbish maintained for public collection shall not be located within a building, shall not be higher thatn the level of the first floor of the building for which such receptacle is provided and shall be so placed as to be readily accessible for collection. shall be and the same is hereby amended to read as follows: 1783.10 LOCATION OF RECEPTACLES. (a) No person shall place or maintain any receptacle for garbage, ashes or rubbish so that it will be or constitute a nuisance. (b) Receptacles for garbage, ashes or rubbish maintained for public collection shall be so placed as to be readily accessible for collection. (c) In an M1, M2, BR, B1 and X zoning district, no person shall store refuse or garbage lawfully retained on the premises pending disposition thereof unless same is stored out of view of the public right of way, within a permanent building or structure or is shielded in a manner approved by the Architectural Board of Review. (d) The Health Commissionerand the Building Commissioner are hereby charged with the enforcement of Paragraph (c) hereof.
