PlaceJ on First Reading July 1, 1985 <br />Placed on Second Readina July 15 1985 <br /> <br />ORDINANCE NO. 52-85 <br /> <br />5¥: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE supplementing and amending Chapter <br />1329 of the Building Code of the Codified Ordinances of the City <br />of Lakewood relating to the regulation of signs by: amending <br />paragraph (a) and subparagraphs (b)(1)(2)(3)(6)(7) and (c)(1) of <br />section 1329.03, paragraphs (f) and (fi) of section 1329.05, and <br />sections 1329.07 and 1329.08; repealing existing section 1329.09; <br />renumbering existing sections 1329.10, 1329.11, 1329.12, 1329.13, <br />1329.14, and 1329.141, to be respectively, sections 1329.09, <br />1329.10, 1329.11, 1329.12, 1329.13, 1329.14; and adding new <br />paragraph (f) to section 1329.01, new subparagraph (b)(ll) to <br />section 1329.03, new subparagraph (c)(9) to section 1329.03, new <br />paragraphs (m) and (n) to section 1329.05, new paragraphs (g) and <br />(h) to section 1329.08, new subparagraph (d)(3) and paragraphs <br />(e) and (f) to section 1329.09 (renumbered), new paragraphs (d), <br />(e), (f) to section 1329.10 (renumbered), and new subparagraph <br />(b)(8) and paragraph (c) to section 1329.15. <br /> <br /> WHEREAS, the City of Lakewood is a Home Rule Municipality <br />and by the authority of the Constitution of the State of Ohio, is <br />authorized to regulate signage for the protection of the public <br />health, safety and welfare, and <br /> <br /> WHEREAS, standards for the regulation of signs shall promote <br />and maintain the high value of residential and commercial <br />districts in the City of Lakewood, and. <br /> <br /> WHEREAS, standards for the regulation of signs shall improve <br />the appearance of commercial areas by the design of signs which <br />are aesthetically harmonious with surrounding properties and the <br />overall urban design of the City, and <br /> <br /> WHEREAS, certain amendments to the existing Sign Code, <br />Chapter 1329 of Codified Ordinances, are necessary by reason of <br />changes of related sections in other parts of the Codified <br />Ordinances, practical considerations based upon experience in <br />administration of the Code, and modifications based on court <br />decisions, all occurring since adoption of the Sign Code by <br />Ordinance 58-79, passed July 16, 1979. <br /> <br /> WHEREAS, this Chapter constitutes an emergency measure <br />providing for the immediate preservation of the public health, <br />safety and welfare of the citizens of the City of Lakewood, and <br />for the further reason that such standards should be established <br />at the earliest possible time; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO; <br /> <br /> Section 1. That existing Section 1329.01 shall be and the <br />same is hereby supplemented by enacting new paragraph (f) to read <br />as follows: <br /> <br />1329.01 INTENT. <br /> <br />Sign regulations, including provisions to control the <br />type, design, size, location, illumination and <br />maintenance thereof, are established in order to <br />achieve, among others, the following purposes: <br /> <br />(b) . . . <br />(c) . . . <br />(d) . . . <br />(e) . . . <br /> <br /> <br />
